DLA declined grrr

I suffer from epilepsy so i cant drive etc.
i applied for DLA, filled the form in myself descibing the worst sort of day i could have and they have declined me as i can walk! i do not understand!
I am classed as disabled to get a disabled rail card, im not registered disabled as i am not that bad.
i struggle to hold a job down due to my health and i feel that its not fair just because i can walk and dont need some one with me 24/7 that i cannot get anything when i know people who arent as bad as me or who also have epilepsy, in a different council area and they are given DLA.

What care needs do you have lynsey?
You say you can walk - do you have problems when walking? If not, that would explain why you wouldn't be entitled to the mobility element.
If you look at your care needs, do you need extra help with things? If not, that would be why you haven't been awarded the care element.

How often do you have seizures,and do you get any warning,or auras prior to them?
DLA btw is nothing to do with council areas its a benefit admistered by the DWP,if you think the decision is wrong then you have a month in which to appeal,but if you request a statement of reasons then this is extended to 6 weeks,I would suggest you get help with the appeal from CAB or welfare rights,as the process is complicated,it would also save time if you approached your gp and neurologist for written evidence of your condition and how it affects you.

You do not know my situation at all! i have regular fits, have injured myself on various occasions! I am advised not to have a bath or go swimming unless there is someone with me!
There are various things that i can not do on my own! i may not be registered disabled but there are many aspects of epilepsy that are a disability and i think some people turn a blind eye to this and dont seem to realise the complications and how it can stop you doing many things that other people can!!

No-one has a 'right' to benefits. The government can and does decide who can and who cannot get them. Therefore, there's no point getting angry about it - there is no 'right' to them therefore you aren't being deprived of anything that you should getFrom Poland...with love.

Hi do your seizures happen when your out . If so you would need someone with you and this would entitle you to lower rate mobility. It is not just for people with problems walking but also for people with severe mental health problems who wont venture out alone or from their usual surroundings. If your seizures mean you lose conscious or have episodes of blanking out then you qualify.0

If you dont need any help, then you wont be entitled to any DLA.0 -

Sorry to hear you were declined DLA but it doesn't end there you have the right to appeal. I would get in contact with your local citizens advice as this is what a member of my family had to do as they were struck off incapacity benefit and DLA after being on it for 20 years. They are very helpful and will help you fill out the forms and they can also represent you if you decide to appeal which is what I would advise you to do. Also get letters from your doctor and any specialists that you see or support groups etc as they will all help to identify how severe your condition is.
