County Court Threat Letter Received

I've received the following letter today from TREVOR MUNN SOLICITORS,
dated 13/01 postmarked 13/01 send 2nd class, received today!

"On the instructions of our client, ARCH (Europe) Ltd., we are writing to inform you that as you have failed to keep to the terms of the offer you made, your agreement to repay this debt has been terminated and the full balance is now due.

Unless you contact ARC within ten days of the date of this letter, we have been directed to proceed with a claim in the Northampton County Court.

YOU WILL RECEIVE NO FURTHER NOTICE OF COURT ACTION.

If you wish to avoid this action, you MUST send a payment TODAY or call our client, ARC, directly NOW on their Legal Help Line 01932 251040 (they will also accept your payment over the pohone by Debit or Credit Card)."

1) I know not to call ARC, but I'm tempted to as the strength of this letter is more than normal.

I'd call to say I've kept up with payments but some have been a few days late. So I don't know what terms I haven't kept? Nor do I think I actually received written notification of them?

Also, the debt amount doesn't seem to have reduced so shouldn't I receive a statement or do i need to request one? AND if it is progressing to court then it should be moved to a county court near me
.
I recollect receiving a letter in December from them requesting an updated SOA but haven't responded to it yet, and could argue I never received it.

Does anyone have a letter template I could borrow to get in the post today?

    It's for an EGG credit card that I defaulted on & made an arrangement to repay with Arc. Have been for several months, probably more than a year. Now they claim I haven't complied with the terms?

    Is this just another idle threat? Should I just ring them, not tell them anything & just find out from them whats going on? I suspect i'll be wasting my time. But I don't have time to write a letter today.

    Any ideas?

    They cannot just terminate your agreement unless they have issued you with a default notice.

    Have they issued one?

    As RAS has requested, what type of debt is this?

    If they are threatening legal action, you MUST stick to written communication only, this is for your own benefit.

    Thanks everybody.

    It's a credit card debt. No default notice issued that I know of.

    I won't be ringing them & will write to them over the weekend.

    Any advice & guidance on the contents of the letter would be good!

    If you have proof of payments , even if they are slightly late, a Judge would certainly question why action was being taken . If you are paying what you agreed the court would not be best pleased. When you defend action it is automatically transferred locally .

    This is very important, be 100% certain you've not received a default notice.

    They CANNOT terminate your account without issuing a default notice.

    If they've terminated without issuing a default notice, they've terminated unlawfully.

    Let them take you to court, then sue them.

    Who should the default notice be from? Egg sent a default notice before selling the debt onto Arc. Arc have definetly not sent a default notice recently. But i'll check my files when I get home in the morning.
