    The irony is that normally the council tells people about to be made homeless to stay in their property until the baliffs arrive. Wonder what they will do in this case?

    Hi Silvercar,

    Id suggest that in this case the council wouldnt apply this rule, as the tenancy was simply not the OPs. they were illegally ( or in breach of contract) subletting and therefore OP had no stability in any way legally.

    this was always going to happen, subletting council houses always gets found out the amount of people I hav heard of that have done it and been found out is staggering!

  • Thanks for the advice everyone... feel like i'm in shock.

    Its very hard to try and think straight when you find out you've 4 weeks to pack up and move with very little cash available.

    This feels a lot worse than it might have been because of the state of the business. I'm going to check up on if theres any help or benefits available while my income is so low.

    You can call it defrauding the council housing list all you like - thats your opinion and whilst we appreciate your advice - your opinion is just that.

    Technically it would have been fraud.... but anyway if your income is genuinely low you will be entitled to LHA which will pay your rent and if you had stayed put in your rented accommodation you could have claimed for it there.

    Ok it wasn't the best idea to get into this situation but you acknowledge that.

    You mention that you have health concerns and it might be worth approaching the council as they will also take into consideration anyone deemed in priority need including those with health problems (depending on the severity/impact of the health concerns).

    They can also advise on alternatives for people who do not meet their housing criteria. Phone Shelter too as they can give good advice and have a brilliant website.

    i already acknowledged that it was out of desperation that we did what we did and if you read the original post properly you will notice that nowhere did it say we
    "expect" the council to now rehome us!

    We're not proud of what we did and all I asked for was some helpful advice and I'm grateful to the people who have given us advice and if my post gave you the chance to vent then I'm glad I could help you too.

    OK, ranting aside, here is the position.

    You have no right to stay in the property, and will be evicted in 4 weeks time. At that time you present as homeless to the council and they have a duty to provide you with emergency accommodation - which may well be a B&B at first. You won't get a choice as to where you are rehoused. Once you have the emergency accommodation you can apply for a council house as normal, although as you have stated you are low priority and will be waiting for some time to get a better place.

    Get on to your local council and see if they do a Deposit Guarantee Scheme (this is where they will pay the deposit on a private tenancy) and find out if you are eligible for it. Once you have found a property then apply for LHA (bear in mind that you will only qualify for LHA on a 1 bed place).
