Length of Time to settle Claim with FOS

Options
Hi all,

Has anyone got any ideas how long it is currently taking for the FOS to adjudicate on a claim for mis-sold PPI?

We forwarded our complaint to them in June last year...and whilst they are continually sending letters of 'update', there doesn't seem to be any idea of an end date.

How long have people been waiting (generally speaking)...

thanks.
Phil

  • Hi there
If you look at the PPI discussion/successes thread you may get more answers there. Mine was settled just before Xmas but took over 14 months.
Also give FOS a ring and ask the status of your claim at present.
    Regards

i rang them and they said that all evidence has been gathered and handed over to an adjudicator...
but wouldn't give me an indication of time just that there's been alot of press interest recently which is causing delays..
  • Hi there
Once it goes to an adjudicator you should not have long to wait. There used to be a backlog so I do not know what the present timescale is, but my claim was decided as a goodwill gesture also take a look at my other posts on this matter.
    Good luck anyway.

    Hi Phil

These actual complaints have risen over the last year or 2.

When was the last time you heard?

I try to help out on the PPI reclaiming discussion thread, you can ask there as well if you want to or check out the success & failiure thread next to that one.

I will give you example of mine.
Nov 2006 resolved and paid out Jan 2008 (through the FOS). But that was a rather complex case.

However, this will depend, I had one send in June/July 2008, this was moved on in Sept to an Adjudicator but the company (Lloyds) did not agree with upholding the case so now its waiting to be moved on from the adjudicator to the actual ombudsman himself, this one I am still waiting. (I think this one it may have been fast tracked as I requested for this due to personal circumstances - although not confirmed to me, yet I heard the other week that this case was waiting to be looked at for fast track to me moved on to the ombudsman, so its ongoing.

My husband, his 2 cases have been with the FOS since July/August 08, he has not heard a word since September to tell him the usual due to the high volume of these complaints its still waiting to be moved on.
Again he requested fast track but this depends on how bad other peoples may be as well to be pushed forward for this.

Yet others have been successful within weeks of when an adjudicator looks at their complaints.
Hope you hear soon good luck.;)

  • Similarly with my case, I submitted papers in May 08, and have been told that it has now been allocated to an Adjudicator who will be in touch before March 4th. So, it's right on target for it's 9 months! I did submit a hardship claim about 3 weeks ago, and I don't know if that's why I'm suddenly being contacted by them about this case.

If all goes well, I'll hopefully get a resolution over the coming month or two and it will bring a 2 year saga against Sainsburys to a close.
Almost debt-free, but certainly even with the Banks!
  • My experience:
PPI case against Egg Loans referred to FOS February 2008,
FOS agreed to 'fast-track' in November 2008,
Still no answer/decision so have had to get the FOS's Service Review Team to look into why its taking so long!

No light at the end of the tunnel even though its in the FOS 'fast-track' process. More like slow-track!

Shame the PPI department don't work as hard and as fast as the Credit Card charges reclaiming department.

Lets hope more people post in this thread about the length of time it takes and maybe something will be done.

Like Sportage1kia mine was a goodwill case and took about 3 months so its not a good example. I think lots are waiting about 12 months odd.
  • My husband submitted his claim against MBNA to FOS in January 2008, after recieving the final letter from MBNA in late December 2007. He received updates from FOS monthly (still waiting to be allocated to adjudicator) until June 2008, then heard nothing until November 2008, when he chased it - it still hadn't been allocated then. FOS told him they had experienced computer problems and that was why he hadn't received any progress updates.

Its now mid-February 2009 and still no news! That's almost 14 months since he submitted the claim, and no progress. Apparently FOS have received the information from MBNA they requested back in May 2008, so we don't really understand this delay. The claim is for £3.5k so its not an insignificant amount of money.
  • Hi, please excuse me for being a little simple, but can someone tell me whats the difference between the FOS, and the financial Ombudsman, or is it the same thing?

I have filled in a complaint form with the financial ombudsman about Welcome Finance. The claime is rather complex and includes PPI recaim, plus a complaint with the Loan as welcome had said that I defaulted when I didn't etc.
Ive also sent a financial hardship claim to LLOYDS regarding a charges claim. Does anybody know what Im up against as I am sinking fast financially and am self employed working probable for around the same amout of money as I would get if unemployed but with no help.
  • Complaint made: July 2008
    Settlement offered: Dec 2008
    Settlement paid: still waiting....

I initially sent my complaint form off to the FOS about Tesco Personal Finance loan (part of RBS) in July 2008. I received a letter from the FOS in September asking me if there was anything else they should be made aware of when dealing with my case for example financial hardship. I sent a reply in October explaining that I was suffering financial hardship enclosing a personal budget sheet. I also mentioned that I was struggling to repay my loan and was only making token £1 payments to RBS.

I then received a response at the beginning of December advising that the RBS wished to settle my complaint on a good will basis. They advised me I should hear from RBS within 2 months. Towards the end of January I emailed the FOS to say RBS had not been in touch. They were able to confirm when RBS received my signed settlement forms and said if I'd not received any payment by today I should get back in touch with them.

If you are suffering financial hardship or struggling to pay back the loan/credit card the PPI reclaim is against I urge you to advise the FOS of your situation.

In April 2008 I also sent in 3 PPI loan complaints to the FOS against the Halifax. I did not mention financial hardship in these claims and was lucky enough to have my complaint settled quickly and the money in my account by the end of July 2008.
