Leaving tiscali (breach of contract): How to do that properly?

    ""LLU" means a process by which BT lines are physically disconnected from its Network and connected to our Network;"

    and take into consideration that I am paying to BT for line rental and if I call from my phone, I am billed by BT (so Tiscalli's billing me just for internet), I would say that I am on BT wholesale broadband connection if I use both BT's and Tiscali's services.

    The only reason I mentioned router statistics as this gives an accurate read of the speed that you router is synchronising with the exchange together with the noise margin and attenuation of the line. It would then be possible to see if Tiscali are not delivering on their prmised performance or if you have other problems.

    Your logic regarding LLU is not correct. Your broadband signal is carried via the BT line from your home to the exchange. At the exchange the broadband and Voice signals are separated, the broadband signal being connected to a DSLAM (digital Subscriber Line Access Multiplex. This could be run by BT or an LLU ( Local Loop Unbundling ) operator who has their equipment in the exchange.
    For acedeic interest you could put your exhnges name into the Samknows website to see which operators are available there e.g Tiscali.
    That gum you like is coming back in style.

    Tiscali use BT Wholesale adsl and also use full LLU (line and broadband same type as Talk Talk/Bulldog etc use) or shared mpf sometimes known as split LLU where the line is a standard pstn line but broadband is unbundled (non BT wholesale)
    put simply you could have a standard BT line and still have Tiscali LLU for broadband.

    If you're from abroad, welcome to the UK - you're discovering how unbelievably backward this country's broadband provision is.

    The average speed achieved by an up to 8Mb connection is actually about 3Mb.

    You will only get something approaching 8Mb if you are within a very, very short distance of the exchange (less than half a mile, say)

    Only about 15% of people live within 1.5 miles of their exchange. In reality 1Mb to 3Mb is normal with ADSL.

    Cable can run up to 50Mb (100Mb on the way) but only about 20% of this country is cabled.

    I think you'll find you don't have any grounds for getting out of your contract I'm afraid.

This gets back to Android's real point - sending a formal letter to senior managers (if you continue to pester me with false claims I will charge you for each letter etc). The CEO and Company Secretary are a good place to start. It worked instantly when I had problems with Sky.

    I'm not a techie but it is obvious that the bandwith is insufficient in the evenings (about 1/10 of daytime speeds) due to the number of users. All I get from the help line (do use the e-mail facility, don't make expensive phone calls) is the standard response to check my equipment. Escalation to the Complaints staff resulted in a call from someone who wouldn't talk to me (data protection) until I had given her all my personal details. Telling her to get lost escalated the problem to a techie who was quite happy just to talk to me but couldn't resolve the problem.

    Pity really because I have been generally quite happy with Tiscali. Oh, except for losing e-mails at Christmas - but you don't want to know that.

    Just a short note that Tiscali offers to customers leaving the UK cancelling the contract without paying anything more. All you have to do is to call the customer service and tell them that you are leaving your country and would like to cancel the contract prematurely. You will be asked to fax your airplane ticket (with your own name) along with a reference number and that's it.

    If I had known that before, I would have asked for the cancellation when I went to my country for Christmas...

    Why, oh why, do we keep getting these "complaints" about broadband speeds ??

    NO ISP will "promise", "guarantee" ANY download speed for several reasons.

    1. Using copper wire (which most people do), the main thing that affects download speed is the distance you are from the exchange. A couple of miles and you are down to 1 - 2mbs - if you are lucky.
    "Up to 8mbs" is a little misleading on another account - the max possible speed from an 8mbs (ADSL) link is actually about 7.150mbs
    2. There are other factors: the condition of the wire, the state of your set-up - even the weather. The ISP has no control over this.
    3. Contention ratio. This is the number of people connected to the same broadband "pipe", if there is only one person using the pipe - great ! if there are 50 it slows right down.
    The ISP can do something about this - put in another or bigger pipe. That costs money, that money has to come from you !
    It's a lot easier and certainly quicker if you move to another, more expensive ISP with a much lower contention ratio.

    Tiscali are not in breach of contract - if they supply with with "one bit per hour" they are still within "upto 8mbs" !
    Like most things in life, the more you pay - the better.
