I would advise you to use the address 3 have supplied.
Any other address could slow things past the 7 days.
Also, don't just send it recorded delivery, use special delivery, costs a bit more but well worth it.

Are you sure the phone came from "3" and not this rogue dealer that cold called you?

I wonder, if 3 manage to delay the OP past the 7 day legal requirement does the OP lose their right to return the phone due to 3's actions?

If he can prove the delay is the company's fault then yes he should be covered.

The law is very clear though, and if he's firm when speaking to them on the phone, and mentions his 7-day legal right, any company should accept it quickly and without too much hassle. In any case, the record of this phone call (most companies tape them, after all) should be enough to prove the delay wasn't his fault.
  • 3 are desparate to hang on to people. It took me nearly an hour on the phone with them to get a PAC code to move my number away. Persist and you should be fine!

I don't think that 3 are to blame here at all - sounds like some dodgy phone outfit has been cold calling and got lucky with you.

Might it be easier to have both threads combined?

If you read the first post it appears the OP was offered a second contract as it says
because I was a loyal customer I was entilted to another phone and a 25% distcount

Another phone isn't the same as a new phone on the same contract and until it is clarified exactly what the situation is it is difficult to advise the OP. However, returning the item securely using a tracked service and within the cooling off period would appear to be advisable except that we then run into the problem that the phone was used.
