This is becoming interesting. Legal and illegal talk with regards to returning the funds. What if you genuinely did not realise the error. For example your account has high activity and things like that pass you etc and they come chasing you for the money many months later. Can you not have a valid legal claim for the inconvenience and stress they have caused you. The only proof you need is that fact you didnt realise the error and then you can claim compo from the bank i.e. return their money but still ask for something for all the stress they caused you.
My understanding of law is that if one party admits mistake and you can prove that the mistake cost or caused you pain, inconvenience or stress, then you are liable for compensation

To be fair that is what everyone wants these days. Oh I didn't know you debited my account with £500 twice, it caused me stress and inconvenience of having money taken from my account which I thought was mine, so I want compensation. I have this, I want compensation. It annoys me. Because there are people out there who actually have problems which amount to stress and inconvenience, but they don't seem to get anything. It is always those who are greedy and want to get an extra buck because of minor issues. Personally, off this guys attitude I hope he doesn't get compensation because he has come here asking whether it is right if he keeps the money or not.

Either way it is wrong what he has come here to do. I suppose he could make the point that he did not notice it because of a high volume of amounts going through the account. But generally you will go through you statement at the end of the month and notice that you have been debited the same amount twice by the Halifax. That would be an instant flag for anyone who knows what they are doing. So in one sense he can say I have loads of things going through my account and didn't notice, but by that same notion he would have noticed it when he goes through his statement at the end of the month. But hey, not everyone is honest and has morals. I am not picking on you in any way, but I dislike the fact that someone would claim compensation for money that is not theirs and a so called inconvenience...

I fully understand the point you are making. We expect people to be honest. But it is very possible that for some account holders £500 could not be noticed due to balance and activity. The banks deserve their money back but they too should apologetic for their initial error - which is the origin of the problem. I dont really want to comment on anyone's intergrity by suggesting their intentions are not genuine. If anyone feels aggrieved over his/her treatment over a bank error, let him or her seek redress. We live in a civilised society hence the rule of law should prevail.
Also the compo culture is very rampant in America and is well justified. In America they sue and they WIN for nearly everything under the sun.. very scary
  • Oh my flipping god I can't believe this has reached the pathetically low level of 'morals' and 'ethics'. For a start my statement that i was a student was not to demonstrate I was impoverished, it was simply to explain why i had quite a bit of money in there.

Thank you for mentioning I came here for asking 'permission' to keep the money. Im afraid thats complete rubbish. I intended to keep the money whether or not you lot agreed with it or not. I'm not here to do the 'right' thing. I wanted to find the best way to keep the money without my bank getting their hands on the money again! Oh yea thanks aspiring for all the winks, you little sweetheart!!

Thats right, I'm apparently not a moral person, you could say I'm about as ethical as a bank!!!

Correct me if Im wrong but arn't you the same group of people who tried forever to get fees and charges back from these money grabbing banks? these banks which screw so many people over, and who are the sole causers of the financial crises? These banks try to take our money at every possible moment, and yet your more concerned that I should do the right thing? If it was a person who sent this money, then I would take a different opinion, but a bank which messed up, I have really no sense of guilt whatsoever!!

You can call me a thief, a crook, a lier or a conman. Banks are also called the same things and worse!

Btw I'm not going to look at this thread after ive posted this, i think its gone far beyond what i thought it was going to be. I was only going to try and find out how to screw the bank over after they screwed over so many people and me. Write what you want cause i won't read it! I guess its going to be a lot of 'corrupt mind' rubbish!! hahahaha! (evil laugh!)
  • hi i had nearlt 15,000 appear in my bank. I rang them and guess wot they said....... if its a bank error they can take it back, this will be done pretty quickly, usually within 1 week. They then said if its still there after a week to transfer it to a high interest account, dont spend it and wait for someone to contact me !!! i was needless to say shocked that they were not going to immediately take it back, even more shocked when he suggested i might as well earn some interest from a higher rate account. they said if its not the banks error they cannot take it back without my permission and that at some point someone will contact them and in turn they will then request the money back. If i fail to return it then the person to whom the cash belongs can take legal action if they wish. Its still sat in my account, but not the original account it landed in....took their advice and moved it to a better rate account. Shame i just dare not place it in a fixed term as i'm certain any day soon i'll get a letter requesting it back !!!

Banking errors do sometimes go unresolved.

I remember back in the late '70s, one of my junior staff, a delightful little Ceylonese guy, came in to work one morning in a high state of anxiety. "I've just had my bank statement", he said, "and there's £132,000 credit just appeared in my account. It's not mine, what should I do?"

£132k is a lot of money now, but back then it was a 'King's ransom'. He phoned the bank, who told him it had been deposited in a London bank quoting his account details. He insisted it was not his, but they were equally adamant it was and that they had not made a mistake. He wrote to them twice insisting it was not his ... they wrote back twice insisting it must be!

So he just put it on deposit. Weeks, months and years went by and nobody ever claimed the money back, and as far as I know he has remained the beneficiary of this 'gift from heaven' ever since.

Now why don't nice things like that ever happen to me?

Hey guys, I was hoping you could help me. Like a lot of students I just got my student loan. Because I had overdrafts elsewhere, I moved some money from my halifax into two of my other bank accounts and also to my brothers. However as I moved this money, it appeared to double when I received it in my other accounts and at my brothers. For instance when I moved 500quid from my halifax to my nationwide over the internet, I was debited 500 from my halifax but credited TWO 500s in my nationwide. Obviously halifax got something wrong, but im not so keen to tell them! I was wondering what my position is, as I haven't done anything wrong!

The money is cleared and I haven't heard anything from either of the banks, does it look like its my lucky day?!

    Cheers, andy

Interestingly this has happened to me recently, Halifax say only one lot of money was debited from my account so they are not interested and the receiving bank says they're not responsible for credits into my account so they're not interested either although they confirm both lots of money came from my Halifax account. I've asked Halifax to put a note on my account to say I've been honest and told them but I'll be hanging onto the money until they ask for it back, they're quite happy with that so I've stuck it in my savings account. Noone can explain it but I suspect halifax will notice they're missing some money at some point.

  • I suspect AndyUK will no longer have his extra money as mine was taken back today, it was taken with no warning fortunately I had enough in my current account to cover it.

    So clearly a banking error.

Not a nice bank. Least Nationwide had the decency to write to me when there was an error and give me 14 days notice before taking the money.
    I'm not cynical I'm realistic :p

Totally agree, I rang them twice trying to sort this out and then they just come and remove the money from an entirely different bank with no warning. Thinking of taking this account elsewhere. I have always avoided Lloyds/TSB as I have heard of them doing this sort of thing from so many people and now Halifax have been taken over by them are they going down the same route?
