Toys R Us and SOGA

Hi there. I'm hoping someone will be able to give me some advice. I bought an Xbox 360 for my partner in September and this week it developed the 3 red lights. I did a bit of research and decided that it would be best to try to take it back to the store where I'd purchased it in the past as we've had some problems with Microsoft in the past (our old 360 got the 3 red lights and we sent it back. They sent us a refurbished one which promptly broke 3 months later, they repaired and it broke soon after so they refused to do anything more).

They customer assistant in the store had not heard of the sale of goods act and her manager said he hadn't either. They said there was nothing they could do. I went home and sent an email through their website and I have so far recieved two emails saying it's not our department, we only deal with online orders.

Does anyone have any advice on what I should do next?

    The general consensus is (I think) that you are better off dealing directly with Microsoft on this one. You can go via Toys'r'us but all you will be doing is adding another step in the chain. You are not going to get a new XBox so returning the XBox to Microsoft is the only route you have, realistically.

    I'd also take the hint and buy a games console with a better reputation for reliability.

    My Xbox360 broke on the day it was 1 year old, which just happened to be xmas eve 2007. We took it back to Gamestation that day and they swapped it for a new one, no questions asked.

    Really? I'm surprised. Good for Gamestation for going above and beyond the call of duty but I wouldn't expect that level of service from Toys'r'us.

    I've looked it up and there are several companies that exchange with no questions asked. My oh has a friend that returned his to HMV, and then paid the difference and upgraded to an elite. I seem to have bought from just about the only company that doesn't. I definitely won't be buying from toy's r us again anytime in the near future...

    Take it back to Toys R Us and demand your money back (or a replacement) under the 1979 Sale of Goods Act (as amended). Do not accept ignorance of this law from their staff - Toyr R Us are in breach of contract.

    Please could you quote the sections of the act which apply specifically in this case? Also, please could you quote the sections of the contract that Toys'r'Us have breached? Thanks.

    That's what I did but both the customer assistant and manager denied all knowledge and said to contact Microsoft. When I got home I sent an email via their website which said:

    My enquiry : Other
    Message: In September, I bought an Xbox 360 from your Aberdeen store. At the weekend, it stopped working. I tried to return it tonight to your Aberdeen branch, but the staff there were unaware of the sale of goods act. They would not replace or accept the Xbox for repair and as far as I am aware, this in particular, breaches the sale of goods act sections 48A parts (2)(a), (3), section 48B (1)(a),(b) and (2)(a),(b). I would appreciate it if you could get in touch with me before the weekend to resolve this situation.

    and ever since, I've been recieving replies saying that I've emailed the wrong department and they will forward the message to their Store Customer Service Department but they won't give me the email of that department directly. :mad:
