Amazon Marketplace: Buyer's right to return

Just one question are you being reasonable? Obviously only you can answer that.
I felt mislead by the picture and description of the item. I thought I was buying a genuine branded item and instead I received a cheap imitation made in china. I paid the price you would expect to pay for the 'genuine' one.
The seller has emailed me before he sent the item to ensure I understood that I was buying 'a limited eddition' by the original brand. It was clearly not the case.
In indsight, I should maybe have researched more before to say ok, but I still think the seller was misleading.0 -
That seems fair enough. The one comment I would make is that the photo is normally inserted by Amazon and not normally the seller (unless they have created the listing). So always be slightly wary of photos. I remember an instance where somenaughty person altered aphoto on a listing and it caused total chaos as it was very misleading.0

Thanks for the advice, I didn't realise that was the case. As I said in my original post I am new to bying on Amazon, I will certainly be a lot more cautious in the future.0

Is it an imitation, or is it a fake (i.e. passed of to be genuine) - if the latter, its clearly illegal to sell, which puts you in a fairly strong negotaiting position.0 -
Be very wary of Marketplace.......
I bought a TV at a cost of £1250 or so. Despite paying for 2 day delivery it took 10 days, by which time I was away working in another part of the country. Courier failed to unpack and examine goods as required.
Two months later, on my return, I started to open the carton and found the screen cracked side to side. Immediately called the supplier (Hughes Direct), who asked me to "go away", but in rather less than polite terms. Filed A-to-Z guarantee immediately, and well within 90 day limit. Amazon rejected three times (each time for a different reason, none of which considered, justified or logical). Then ignored all correspondence, leaving me with no option but to pursue through small claims court (hearing scheduled for March).
Also claimed against credit card company (Amex) under S75 of the Consumer Credit Act. Despite have taken my money for the transaction and listed Amazon as the recipient, Amex are trying to claim excuse from S75 on the grounds they did not have a pre-existing arrangement with Hughes Direct, only Amazon. This will probably be tested in court, but if sustained by the court will mean using Marketplace effectively would remove all normal credit card protections, which would be an astonishing loophole.
In my view Marketplace is a dangerous, and on the face of it the A-to-Z guarantee worthless. Let's see what the court thinks.0 -
