Amazon Marketplace: Buyer's right to return

Hi,
I need a bit of advice please as I am not very experienced at buying from private sellers on Amazon.
I bought an item, received it and felt very disapointed as it did not match my expectations. I emailed the seller to explain I would be sending the item back and he replied saying he would not offer a refund as "he does not have a 'refund/exchange' policy that you may expect from a high street / internet shop" and that he would be out of pocket because of the postage and amazon's commission.
From what I read on this forum I have got the right to get a refund, is that correct?

If as you say, the trader was a private invididual not selling as a business - then you dont have any right to return the item. And he is correct about being out of pocket on Postage. If so then ask him how much he would be prepared to refund minus his costs.
If he was selling as a business then you probably have the right to return. In theory. But its not enforceable against Amazon / Play traders unless you a) Know their trading name / address (You have no right to that information from Amazon or Play if the seller didnt supply it!) and b) fancy going via the small claims court to enforce your rights.
Amazon and Play provide a 'front' to business traders that lets them completely ignore their legal responsibilities with little fear of any comeback.0 -
i believe all amazon marketplace sellers have to accept returns for 30 days regardless of wether they are a private or business seller.0

But are not enforced by Amazon, hence are utterly worthless. Notice it says 'contact the seller', and 'In any case where a refund is necessary'--......--'it is the responsibility of the seller to request that refund'

Yes they are enforced just read some of the rants on the seller boards!

They put you under a lot of pressure to sort things out. I had a rather dubios return once where the seller had basically opened and used a brand new electrical item and then wanted to return. Was not a happy budgie.0 -
Thanks all for your replies, I have sent the seller another email quoting amazon marketplace refund policy and told him I would claim under the A-Z guarantee. Waiting for a reply.
I'm off to the post office to send the goods back, on recorded delivery!
