Hi all,
Meeting at Welfare Rights this morning went well. They seem to agree that my husband should have been exempt from filling in the IB50 in the first place due to his illness and the long term medication.
I'll hand everything in to CAB on monday and we'll take it from there. Still got to send letters to Head of IB and also the Tribunal as advised but we'll get that done asap too.
Thanks again everyone, fingers crossed this goes our way ...

Thanks for the update, I'm sure all the posters on this thread were thinking about you today.
Only 3 weeks till the tribunal. I don't know if the tribunal can make the decision that the IB50 was incorrect, and so can dismiss the case, or if you have to go thru the process.
At least you now have another opinion, and that should help a little,

I think if you can get a letter from these sources and write a letter yourself, mentioning your husband's condition and the stress all of this is adding to his already delicate and vulnerable state, causing his health to deteriorate rather than improve and if they are prepared to accept responsibility for this, not only should his Incapacity Benefit be restored with the correct points, but he may not have to attend the Tribunal as it will be causing him unnecessary stress and anxiety.........act fast though!

great news!!! actually, unbelievabley GOOD news!!! :T
my husband has just called me and let me know that he had a phone call this morning to let him know that they'd reviewed his case and reversed the original decision. He's got his FULL Incapacity Benefit back and it'll be back dated till the end of October last year!!! The tribunal set for next week has now been cancelled so he doesn't have to go through it. Case closed! :-)
many many thanks to everyone here for their advice and encouragement - we couldn't have done this without you. the CAB commented on how easy we'd made their job with all the information we handed in. She also said that she thought my hubbie should have been exempt from filling in the IB50 in the first place because of the long term medication etc he has been taking.
if we can be of help to anyone else in the same situation in the future just let me know and we'll do what we can.
so glad this is over and done with now.
