i wonder if any one can give me some advice regarding tennants in common. i, inherited a piece of land with a tennant in common, who i have never met,i wanted to seperate the land into equal halves and give my partner first choice of any half, he said no. but to put the land up for auction i do not want to do this as ,i would like to retain my portion to keep it in the family my joint tennant in common is quite wealthy and could easily outbid me at an auction ...any ideas ...yours calton

if 50 50 share each has rights to call sale.... he can call sale so u will have to buy him out, no other way sorry also tennant in common

Also if your tenant in cmmon died, went bankrupt etc, his share would fall to his executors, trustees etc who would be able to force a sale anyway

That you will have to sell is correct unless land is still in the estate and another intention can be found in the will.

You each own half; it would be unfair if one of you could not get any money out of that half because the other one didn't want to sell.
