XL - no luck getting refund from ATOL, Coop Agent or Tesco Credit Card

As for 'joint and several' liability, I cannot see a situation where a court or ombudsman would force a credit card company to refund you under Section 75 of the CCA unless the ATOL/CAA fund somehow ran out of money or refused your refund for some reason.

YES THEY WOULD REFUND - look up what joint liability actually means! They can approach the card company. They must refund them. It won't go to court because the court would demand that the card company refunds them! It doesn't matter that there is another means of reclaiming the money, because they are entitled to persue both the agent and the card company for a refund, the law is very clear on this and some people are giving the poster bad advice.

Hi - thanks for the numbers I will try them when I get back in the office next week. I will also try Apollo customer services again and try not to get fobbed off onto the recorded message.

Hi. I tried Apollo customer services, had a friendly chat about how their computers and refund process works and managed to find out the name & number of their operations manger in charge of processing the XL refunds.

I then phoned the operations manager (who was away from her desk) and spoke to a colleague who confirmed that Apollo did recieve and process our claim and sent it to 'hq' in Oct-08 for further processing. The lady then provided me the number for 'hq' but had no more details.

The number for 'hq' was actually Cooperative Travel reception but the receptionist transfered my call to the manager in Coop operations manager who was having a problem with his computer today (password locked out) but assured me that he had all the details on a excel spreadhseet. I asked if he could acccess the file from another network pc but apparently the file is definatley on the local harddisk. Apparently he has no backup of this file. He said that he had logged a call with his local desktop support team and would call me back when he could login again.

Feeling satisfied that I have made good progress today I will chase the guy again tomorrow before calling the CAA numbers that flyaway has provided me with.

    Thanks, alex.

As I asked previously, was the money taken by the travel agent or the tour operator? If it is the former, have you asked Tesco Finance to do a chargeback against the travel agent? If so, what did they say?

Hi, the card payment was made on my girlfirend's tesco credit card. I will findout the payment details on her online banking tomorrow. alex.
  • Hi, great news!

A letter has arrived from CEGA Air Ambulance Limited acting on behalf of CAA (not sure what the link is but nevermind) with a claim reference and telling us that they have processed our paperwork and expect to provide a refund within 40 working days. This is conditional on there being enough money in the CAA claim pot. Given that the CAA is short of money at the moment then this is a slight risk. However it is progress so I am happy!:rotfl:

The CAA 'claim pot' has been empty for a long time, years in fact. The good news is that they have a bank borrowing facility guaranteed by the government, so you should be OK. Cega have lots of staff who process claims for a number of companies, including ABTA I think, all they do is check the paperwork and then ask the CAA to OK the payment

I am in the same as most other people. Booked holiday through Travel Republic who bought flights from Freedom flights. Paid using Tesco credit card. I have received all of my money back from Tescos. However now I have received another letter saying that in 3 months time they want their money back. What a shambles.

Hi the reason is that they have said that the caa are now responsible for making the payment therefore I need to contact the caa to get my money back. I personnally think that Tesco have admitted liability by paying my money back in the first place. I received my money from them 2 months ago so I think they are behaving disgracefully.
  • Sue Tesco - they are the softest target and most likely to pay up. only do that if ou get no help from the ombudsman.

    Hi,

I heard on Radio 4 Moneybox that CAA have changed their policy on Credit Card payments in recent days. We had a letter from CAA telling us that they would pay within 40 working days (no sign yet). Am now expecting to recieve the following letter that they have put on their website:

    http://www.caa.co.uk/docs/1804/XL_card_referral.pdf

Does this mean that we now need to log a new claim with Tesco? Tesco wanted original tickets but these have gone to CAA so we only have photocopy evidence. Also I understood that credit card chargeback needs to happen within 120 days of the indended flight date - is it now too late?

I am starting to give up any hope of getting this money back :-(
