question on CarPhonewarehouse purchase

My friend just bought a new mobile (with contract) from Carphonecarehouse. she said she needed to have a phone that she can take today, and they gave her a new Motorolla v3 with T-Mobile.
They also asked her to supply bank details and proof of address, which she has yet to do. However, right now she just needs to phone, as she still has another contract with Vodafone. The Vodafone mobile got damaged in an accident, but the SIM card from it is fine.
She is currently using the Vodafone SIM in the T-Mobile Motov3. There are two things we like to know:
1. She is thinking to cancel it, as she has found a better deal, can she do that?
2. As she is not uising the new T-Mobile SIM, she should not get charged, right?
3. How come the T-Mobile v3 allows a Vodefone SIM to work in it?
Any thoughts, answers, ideas much appreicated

1. The CPW have different refund and exchange policies from most other mobile phone retailers, the general rule of thumb is that when you take out a contract you have a 14 day cooling off period, as far as i'm aware you don't get this with the CPW on T-Mobile connections
2. Not sure about this one, has she been advised to phone up and get it connected??
3. The CPW mobile phone stock is not locked to any network and therefore her Vodafone sim will work in it.

1. Are you saying you want to cancel the Vodafone or the new TMobile phone?
2.Yes and No. Yes you will be being charged line rental if the new SIM is "live". If the line rental includes some bundled minutes then you will be allowed to use those minutes without being charged, ie if you have 200 free minutes a month inclusive in your line lintal then for each day it is live you would be entiteld to use one thirtieth of those minutes. No, she would not be charged any additonal call costs if the SIM was not used for making calls.

Question 1) If she cancels the new T.Mobile deal she will have to return the phone unused and the sim and comply with any other requirements that the CPW have in operation for buyers that change their mind.
Question 2) The T mobile sim if it is a contract will have a monthly charge, whether or not the sim is used. She will have signed up for a monthly payment plan and checking what plan she is on will tell her how much she has to pay per month. Typically T mobile offer 12 month contracts, although she may need to check that as they are also moving into the 18 month contract area. However, if she does not use that sim all she will pay is the monthly charge, ie £25 per month, she won't incur any additional usage costs.
question 3) Some phones come unlocked.
You may want to ask her how much time she has left on her vodaphone contract as if she is out of contract on that one it will probably pay her to give notice on it and port the number to the new T mobile sim to use any inclusive minutes she has in her montly contract.
Otherwise running two contracts is going to be expensive and it might have been better to just buy a PAYG phone to take the Vodaphone sim.

Also may be an idea to contact the Vodafone Retentions team and tell them your leaving and see what kind of deal they offer for her to stay0

I think she can get a much better deal and hence thought it be better to cancel the newly taken out T-Mobile deal (if she can indeed do so?). Although she is using the phone (without having taken off all the clear plastic film that protects it), she has not actually used the T-Mobile SIM?!
Vodafone is out of contract period now, so eventually she'll request a PAC...0 -
Ok well of course it depends on CPW's returns policy. Below is the policy if you bought it via phone or online:
• As you will not have had the opportunity to examine your product before purchasing it, you are entitled to cancel your agreement with us under the Consumer Protection (Distance Selling) Regulations 2000. If you notify us within 7 working days from the day after receiving the product (the "Trial Period") we will provide you with a full refund.
