Seller being unreasonable

    Correct. He gave me a refund with the promise I'd change the statement in my feedback. I did, he still had a big go at me.
  • Im guessing he assumed that when he asked you to change his feedback he meant to change it from a negative. Theres not really a lot of point just removing a comment the negative mark is the big issue for a seller.

    If he gave you a refund, it would be normal practice to open an unpaid item dispute as this will be the only way for him to get a refund from ebay for the seller fees.

    He should have opened the dispute as a mutual agreement though, which would usually be the case in a refund situation, thereby he would get a refund of his fees if you agree. Then you wouldn't get a unpaid item strike.

    Did he open the dispute as a mutual agreement or a 'buyer never paid?

    Unless it is a mutual agreement then he's clearly being unreasonable, in which case hopefully ebay willl be able to see that you did pay and were subsequently refunded and therefore not quilty of failing to pay.

    It is not normal practice really for a seller to reclaim fees on a failed transaction, obviously though some sellers will give it a try.

    As the OP has paid he can easily defend any claim for non payment merely by showing his original paypal transaction number.

    I think most sellers (even the honest ones) would try to reclaim their losses as much as possible.

    Of course you would claim your fees back. If I sold my house but the sale fell through, the estate agent wouldn't keep his commission. If you bought something on the high street and returned it because it was faulty. You wouldn't ask for a refund minus VAT?

    Same thing in my book.

    Not really the seller send the wrong item to a buyer, and has ignored emails when the buyer has tried to sort it out. If they are bad sellers then they should expect to make a loss on fees if this is how they treat people then I can not feel sympathize.

    Well it's at an end atleast.

    Earlier today I received an unpaid item dispute (wasn't a mutual agreement). So I appealed by forwarding an email from Paypal saying I got a refund, to Ebay, who not long ago removed the strike :D

    Take that 'Gaz'.

    Well I certainly won't be using him again!

    That's what he did I think. But you'd think the picture should atleast look the same.
