Can I claim again?

I made a successful claim against HSBC somewhere in 2006 for the previous six years of charges. I have now managed to close my HSBC account but wonder if I can reclaim the charges they placed on my account after the first claim?

When you accepted your claim in 2006 did it say "you can not reclaim on this account for any charges made after this date?" I know it did (maybe not to those words but certainly did say you could not reclaim even 1 charge after your claim was settled) RBS anyway. Maybe if you still have the paperwork give it a read over. xx

Irrespective of what the wording was, the bank cannot force you to sign away your legal rights

Thanks for the reponse guys. So basically, I can claim again, even if their letter offering me the money previously stated something along the lines of me not ever claiming from them again?

I was also wondering the same thing. I made a successful claim in either 2006 or 2007 but have had a hell of a lot more charges since then and would like to try and claim them back too.

Do you think it's worth just going for it? I think I will try.

Banks are not allowed to close accounts because you claim under the FSA Waiver on Bank Charges. A number of banks got fined for doing so prior to the OFT Test case.

    Hi natweststaffmember
Thanks for that, I think I will go ahead and claim if they cant close your account. I thought they could close your account if its the 2nd time from the same account that your claiming?
    cheers

the firm must not close accounts or threaten closure of accounts of customers when it might reasonably appear that this is for the purpose (or with the intent) of penalising customers that have complained about unauthorised overdraft charges for having complained, or deterring future complaints from these customers or others. For the avoidance of doubt, the firm may close accounts or threaten to close accounts where there is good justification for doing so based on the circumstances of the particular case;"
