income based job seekers allowance

hi i am currently getting contributions based job seekers allowance. i know i only get this for 6 months but do i then automatically get income based if not in work?? i have a baby and my husband works full time but we couldnt live on his wage alone. im worried sick.
i have applied for a job though its only 8 hours but hoping if i got it could lead to more hours. would i still get jsa in the mean time?

Without knowing how much your husband earns, it's impossible to let you know whether you'd get means tested JSA.
  • what is the limit for my husbands earnings? can you tell me this?

If your husband is working full-time (More than 24 hours for benefit purposes) then you will be disallowed JSA(Income Based). The amount he earns is irrelevant if he is working more than 24 hours.
  • so i take it i would not be entitled to anything else?
how do they expect people to live on fresh air?

Oh no! My DH is on contribution job seekers and was assuming he would go onto income based but I am a full time childminder although my net profit doesnt reflect a full time wage! Do you think he wont get any more job seekers once contribution runs out??

    Thats a good question.

Childminding is a specialist occupation. I'll have a look over the decision making guides to see what they say again. I think there might be an exception there but not sure what way it impacts.

Does you currently get Child Tax Credit and/or working Tax Credit ? I'm not an expert but this is calculated as a couple so if your income goes down then I would think that you should get more (I think your husband would have to claim it as the one whose currently working)
  • we get child tax credit at the moment but not very much.

I've quoted what I think is the relevant bit below. It looks as if childminding is treated as a specialist occupation only when it is done in your home and when you are on Income Support. If your husband continues on JSA then you would be considered to be in full-time work.

Thats my interpretation though - someone else might see it differently or know more about it.

For IS purposes, people who are childminders are treated as not being in
remunerative work as long as the childminding is done in their home1. If the
childminding is done in the employer’s home the hours worked will count towards
    the remunerative work exclusion.
Note: For JSA purposes, all work as a childminder will count towards the
    remunerative work exclusion.
