tbh i don't know the legalities so don't take what I say as gospel, take a look at this web page, it may help you. I was going to try to explain, but I may translate it differently to yourself

The first link didn't tell me anything I didn't already know, but I find the second link astounding. That a verbal agreement can be considered binding... it doesn't state in the article that the conversation was or was not recorded, and if there is no record how can either party hold the other to the agreed terms.

In your position I would request that O2 demonstrate the contract you agreed to, either by written copy or by recording of the conversation. If they can provide a recording, it should confirm your story. If they can't provide this, I would seek legal advice as to how they are expecting to hold people to a contract without a proper record of the agreement.

I might have to ask a properly qualified friend his opinion...

I called again, and I have to pay CPW £10 for a copy of the recording!

However it has been escalated to the investigations team who will listen to it and call me back within 72 hours. I can remember specific parts of the conversation and if I get any inclination that they are not telling me the truth I will have to pay to get my own copy.

I never received a copy of the contract/deal in writing, though I had expected it.
  • Well done to CPW for a change. Got a call back frpm loyalty investigations to confirm that I was quoted £20. She then said that the C902 wasnt available at that price, but they would credit the account with £90 to make up the difference. I guess the sales advisor made a big boo boo at the time!
