  • Hiya Emby well done for getting it all sorted so quickly! I had my house repossessed last year and when I went to court they gave me a 28day notice too - however I had found a private rented house anyway BUT you get those 28 days then a further 28 days as on the 1st 28 days you then get a warrent for eviction this gives you the 2nd 28 day notice so you have approx 8 weeks to sort yourself out. Before I found my rented house I whizzed down to the council office (which I am defo no snob but did not want a council house but beggars cant be choosers), explained my situ and they put me on the URGENT list as if found nowhere I would be regarded as homeless - now if this happens they sort all your details and sort things out with housing associations who will be able to house you straight away (some really nice ones too). Thankfully we didnt get to this but went through the whole process and they are so helpful, so get down your local council office and tell them whole situation and demand help - dont know if you have children but if you do play on this!

good luck and keep us posted on situation - hardest bit all done tho oh and get packing :o)

    Hi all,

I would like for a little advice if I may!

I am looking at rental properties with a couple of friends. If I can house share it dramatically reduces my outgoings.

Where does a bankrupt stand in relation to signing a tennancy agreement? Is it allowed? Are there any ways or means to work around this?

    Thanks!

There is no problem signing a tenancy agreement at all, so don't worry about that.

    Hi all,

I realised something really important last night which am concerned about.

    1. For various reasons I am not in my office for the next couple of weeks. I am still currently director but not active. The company goes into administration at the end of January. Will it cause problems/get me in trouble with the OR if I don't find a way to quit as director immediately or should it be ok to do it when next in in 2 weeks time? Bankruptcy was 12.01.09

    2. On the form 6.30 'Bankruptcy order' The have put the completely wrong date of bankruptcy. It says 4th January 2009, not 12th Jan. The correct date is on the paperwork I submitted and signed with a witness at the court. Will it cause any problems? DO I need to get that bankruptcy order date corrected?

    Thanks all,

    Emby

Just tell the OR when you speak to him.

    Thanks all

Hopefully someone can give you a definitive answer on the directorship.

    Hi Emby,

I would suggest you end as a director, think its a 288b form you need (Free to do) http://www.companieshouse.gov.uk/forms/formsOnline.shtml i did this myself not so long back and my company currently has no directors.

    Hope this is of help.

    Thanks for the Reply chris!

Does it matter temporarily that the company would have no directors? Seeing as it is going into administration anyway I don't suppose so but thought I had better check!

    Thanks!

I wouldn't have thought so. If you are at all worried ring the Insolvency Service of Business Debtline and double check.

    Hi Emby,

I am due to go bankrupt next month, being a director would cause a problem, companies house confirmed the company can run with no directors for 6mths, if no directors are assigned the company may be struck off, however when the company goes into liquidation the insolvency pratitioner will ask why you are no longer a director, just tell them you can not be a director as you are going through bankruptcy, they will be fine with it.

Thanks for the post Chris! Great info.

Today I went to Barclays and opened a cash card account with a connect visa electron card which is great as it still alows me to pay for things in the shops using card etc. I was really pleased as I was there less than 20 minutes and the account was open immediately so I put £20 in that I had in my pocket!

Another bonus is that they said the card would be with me by early next week (4-5 Business days).

I am assuming that having a cash card account but with a visa electron on the card is ok!I asked the lady four times to confirm that I was ok to do that.

I don't need to inform the OR do I?
