Hi all,
Tomorrow I have my court hearing for my house reposession and have decided that I might as well file my papers (Which I filled out online) at the same time for my bankruptcy. Do I need to pay anything when I do this or do I just have to pay on the day of the actual bankruptcy hearing with the judge? and how much is it?

I have decided that instead of posting lots of different thread all of the time I will post my queries and experiences in this one thread.
My business is going into administration in the next few days. Before the business got into trouble in the summer (When this economic turmoil really hit) I personally had never defaulted on anything.
I rely on the business for an income but it couldn't give it to me, hence being here as I then started to default on everything.
I foresaw problems and asked for help from my mortgage providers and other lenders. The answer I received in one case was quite literally
'The computer says no we can't help you'
which was amusing and shocking at the same time. My response was
'If you don't help me I wont be able to pay you anyway'
to which the lady on the phone replied
'Well there is nothing we can do!'
I knew then that I was only leading to one inevitable outcome!
Tomorrow I have my court hearing for my house reposession at which I am going to ask to stay in the house until they sell it as I have nowhere to go at the moment. What have other people found on this? Do they let you stay? How long do they let you do this depending on circumstances?
I will try to file my bankruptcy papers at the same time and will try to get hold of the £495 (Thanks for the advice Merry_Gentry). If there is no drop in service I will book an appointment.

Have you spoken to CCCS/CAB/Nat Debtline. You need to make sure that BR is your only option.
Please, please don`t go down`Bankruptcy Road` unless you ABSOLUTELY HAVE TO !!!

Hi there,
I have spoken to my accountant, Payplan, an IFA etc all advising bankruptcy.They all believed it is the only realistic option considering my circumstances.
I have no income and with the level of debt, I have little chance of finding a job where I would earn enough to pay £2700 Per Month on creditor payments + food, car, fuel, etc.
Another factor is that my business (About to go into administration) has considerable debts + I am personally guaranteed on many of them. That will all be called in when the company goes down shortly.
I will give the CAB a call though. As I had not done that.
I am in a situation where I cannot see myself digging out of this hole and the feedback received so far, especially from my business accountant who is experienced in this area seems very solid.

I am pleased you have taken advice...perhaps try Bus Debtline (part of Nat Debtline & remember `best advice` is always free & impartial) as well.
I guess there will be many facing similar to you in 2009 & there is no point delaying the inevitable...just make sure that you leave no stone unturned before you jump. Sadly the effects of BR last a long, long time.

I had my house reposession hearing this morning. It lasted all of 5 minutes!
The Judge was very sympathetic but as I was unable to make any offer on repayment of the arrears and the balance she granted the reposession order.
I have 28 days BUT she said it might well take a few weeks longer. I am going to make the assumption that I have 6 weeks to find somewhere to live. Unfortunately it will be difficult as friends and family don't have any room for me.
I have spoken to CCCS this morning and have done an income and expenditure interview and advice. They agreed bankruptcy is the only real option.
I have an appointment for 2PM this afternoon.
I have a couple of questions if anyone is able to help.
Is it 3 copies I need to print out for the bankruptcy?
I filled out the application thoroughly online. Does that print both the petition and statement of affairs for me?
What happens at this meeting when I hand in the forms and the £495?

Today I was like a hare in the headlights!
I had been told there was about a 3 month waiting list for bankruptcy so when I went in to file my papers and pay the fee this afternoon I didn't expect to be immediately ushered into the judge! It was the same judge I had this morning for my house reposession which work well in my favour as I had already had a good chat to the lovely lady about what had lead to the situation I am in.
I was in there less than two minutes beofre she signed it off!
I then had a 10 minuite chat with the official receiver and that was it. He finished the conversation by telling me that they would write in the next two weeks and let me know if they wanted to see me for an interview.
Im glad to say that everything happened so fast I didn't have time to get nervous or worried and have come out of the court feeling relieved and really quite happy as things are finally moving forward!
