Kelloggs....I understand what you say about by joing the 2 csa payments together this would mean only 25 % of income taken. But the concern I have is that the csa are saying this is a backdated debt. The child in question is 5 years old, not 8 as I first posted. So is there movement on there side with changing the figure of the £570 oer month, regardless of what he earns and the family that he is supporting now? Thanks0

Thanks again.. How do you prove that you did not get the MEF. What documents or procedures do we go through to do this? Is it too late now to stop them taking this money at the end of the months paypacket?0

First of all: financial support and acess are two different issues. It makes no difference to his obligations whether he sees the child. (I wish people would remember this as then maybe we wouldn't have to keep going back to court to enforce the contact order every time the CSA screw up and "forget" to pay PWC so she decides right, you don't get to see your daughter today). OK, rant over.
Having said this, my advice to you would be to find out whether the case is under the new or old rules. Under the old rules, the CSA can only backdate for 6 months. We appealed on this basis and had £1500 knocked off hubby's debt. (PWC had been receiving cash payments, went to the CSA and claimed never to have received anything, they took more than 2 years to sort it all out and slapped hubby with a huge bill).Don't see the point anymore in offering advice to people who only want to be agreed with...0 -

Is it too late now to stop them taking this money at the end of the months paypacket?Your partner needs to contact the CSA and ask them what address they held for your partner when the MEF was sent out to check if it corresponds to your current address ~ as when your partner was traced via DWP systems or given address by ex partner it may not have had his most recent address.
The computer system should hold start and end dates on the address screen and there should be a log on the computer as for what date the MEF was sent out so should be able to tally the dates for where it was sent to.
I also assume that your partner has not received an assessment notification either as the first he heard was via employer so at least 2 letters ( but should be more as also should have had a DEO warning letter issued too) going missing seems a bit odd ~ so potentially wrong address held.
Can he also speak to his employers re: what address is held on the DEO ( deduction from earnings form) to see if this one is correct, although his employers have possibly provided the correct one to them by now as they would have been contacted to get his wages but if they haven't it could be wrong and therfore further proof.
Another point that you should consider too is that if your partner states that he has not been contacted ~ how does he know even if the application were to stand that the CSA have got all facts ie: who else lives in household as pointed out previously your 2 children live in the household and therfore would get 20% off net income before any maintenance calculation made.
Oh and finally is he sure he is the father??

He would be much better off going through the csa for all children because as Kellogs says they can't take into account the voluntary payment. He needs to consider though if this is going to disadvantage the children who live mainly with his ex wife. Perhaps you all need to sit down and discuss if she can afford to take less and how much less you could afford to live on. Is it possible for you to get a part time job? It is the repsonsiblity of the parent to support their children. Is there a non resident parent who could support your children, allowing your partner to support his children?0

Hi...update...spoke to csa...He owes £8,000 in arrears for the maintenance, it is out of the csa hands now as they have been sending correspondance to him (albeit at the wrong address) so is now with a debt collection agency... When my partner mentioned about the wrong address, because he already had a case open many many years ago for maintenance of the 2 children he sees and supports now (via ex-wifes bank, not through csa) and an address for correspondence, the csa are saying that it is my partners fault that he did not inform them of his change of address.....even though all ex wifes payments are done between themselves and this case with absent child has nothing to do with his 2 other children!!!!!!! Hope this all makes sense, sorry just typing as I am thinking, am all over the place at the moment... Any further advice much appreciated!0

Just read back your reply, sorry for not answering your questions. I have only beeen living with my partner for 3 months, and was a big move for us all, so wanted to get the children settled into school etc, I have been looking for a part time job but getting something to fit in with school hours is proving quite tricky, bearing in mind that I dont have any family support to help out. I also with the small amount of divorve settlement I got wanted to do a Beauty Therapy Nail Tech course, with a view to sarting my own mobile business. As we were scraping by enough for me to be able to do that, now with this losing £570 a mnth on top, I will definately have to get a job. The thing that is most worrying right now is knowing that money is coming out in this months pay, with 2 weeeks notice, and 3 of our childrens birthdays in the next 4 weeks.....ohhhhhh!!!!!!!! xx0
