    You cannot opt to make such agreements with regards the loans as the law overrides such private agreements. What were the loans for and do you or she have the benefit of them? eg if a car loan, does she have the car?
  • Many moons ago I too had problems with the CSA - they took over 2 years to sort out the maintenance payments.
    As has been mentioned, contact your MP.

    At the time of my problems there was a lot of publicity about absent fathers wanting to commit suicide over the outrageous payments!!! I wrote to my MP saying that I as a mother with no money felt the same way; I explained the stress I was under, the frustration etc and - within the week he contacted the CSA within two weeks I received £1,697 from the CSA (not maintenance from my ex husband). The letter that was sent with the cheque said that this was in no way compensation! Doh what was it then Father Christmas early!
    what would you have to write in the letter do u write to complain or to ask for compensation
  • sorry to explainn a little more my first claim went in in 2001 its now 2007 i have not received one penny from my ex husband for my girls .. i do keep ringing for years and years i have called they dig my file out and seen to put it back until i ring again :(
    can anyone give me any help do i write to complain or do i ask for compensation ?? any ideas / help would be really helpful

    Compensation will be considered once the complaints officer has looked at your case and decided that there is a case to answer. You cannot for example, get compensation because the legislation is defective, but you can if there is evidence that the cSA failed to act properly and in accordance to either the legislation or the procedures and caused long delays etc. When you complain, state what the complaint it and what you want out of it. Don't hold your breath with the amount, the amount stated in Careful-Shopper's quote is extremely unusual, the usual amounts are measly. about 25 - 100 quid.

    I realise this, but also, as we have no money, we are not going for Divorce, we are seperating although on a permenate basis. Nobody is benefiting from this hugh loan. The only benefit is that in Oct 2009 I get 12K from the insurance, because I haven't claimed. Although 3-4K will go paying off her parents loan they got for us. The rest, I will ensure me and my children have a very nice holiday somewhere HOT :D

    Hi everyone

    Can anybody help me?

    My boyfriend is divorced and has two children who live with their mother. They have an arrangement between themselves for maintenace for the children which he always pays weekly no problem. My query is, is his oldest will be 18 in February and is leaving school in June/July once her AS exams are taken. She is then hoping to go to college in September to take an aromatherapy course. When does he legally stop paying maintenance for her? Is it when she starts college in September or when she reaches her 19th birthday in Feb 2008.

    When the child benefit stops, which will be sometime in September if she leaves school in August.

    Sorry Prudent but you are incorrect. As the child is resuming full time education in September maintenance will have to be paid until the 19th birthday next February.

    Hi thanks for your reply does it make a difference as the collehe course will only be for 3 days a week so not full time education.

    This may still be a full time course; many full time courses are less than 16 hours nowadays. The college would be able to say whether this is designated full or part time.
