    Thanks for everyones replies. I'll get him to speak to his daughter to see if course is classed as F/T or P/T.

    Yes she does have to consent, but you can come to an arrangement between yourselves instead, unfortunately whatever money is taken off you your ex will only see £10 per week of it.


    If its peace of mind 2 years after I first went on IS the CSA never got in touch with me, 6 months after that I rang them up asking did they want details of my ex :o
  • Alex, is he he happy to keep contributing to his daughter's finances whilst she is going to college? I presume she will still be living with mum whilst she's completing her course and hopefully will get an income from taking a part time job. If so and the issue is simply that he finds it uncomfortable to keep giving money directly to his ex, would he consider giving a lower sum of money directly to his daughter.

    Using this method would assist a good start for daughter to take responsibility for managing use of her own finances but with the onging support of both her parents whilst she starts off in adult life. It also enables daughter to appreciate real time that dad is still very much a part of her life.

    He can make it clear that his continued support is conditional on her remaining at college which is always a good little incentive for her to stick with it even through the boring bits!

    Edit : Is daughter also aware she is elligible for up to £30 a week Student grant paid directly to her own bank account for as long as she is a f/t student?

    His daughter has a part time job already and has said she is going to increase her hours once she finishes school. I beleive she is already in receipt of the student grant. I think he will have a chat to her and probably discuss giving her some money direct so he knows she has got something for course books etc. he only wondered what his position was legally as he will be moving out of his parents in the summer into an agricultural tied cottage. With his job in farming wages are not that great.I am sure she will stick college she is a very detemined young lady with her head screwed on. makes a change.

    What is the loan for? You say that nobody is benefitting from it, but what was it for? Is it actually a loan or some sort of savings plan you have signed up to? I am confused because you say that the only benefit is a 12k insurance payout?????

    The reason I am asking is not to be nosey, but to establish whether you have a case for applying for a Variation on any CSA assessment. Certain criteria apply and if you have to make payments for a loan, it may qualify which would lead to a reduction in your maintenance.

    How much is your take home pay? Do you have any children who live in the house with you? Does the baby stay over night with you at all?

    So which is the better system (if any) in your view? I am on the old system claiming for my newphew that i bring up, i have never had a problem and have always recieved payments on time, would i be worst off to ask for it to be put on the new system? Not that i intend to as im not touching what isnt broken as it seems im one of the lucky ones who hasnt had a problem. I am just wondering which is the better system for both parents?

    You can easily work it out if you know what the income is. It will be better for some and worse for others on either system. It usually works out that the NRP pays more under the new system if he has high housing costs as these are ignored, whereas they were taken out of the equation in the old system.

    If you were to apply under the new system bear the following in mind:

    Based on NRP's net income which is gross less tax, national insurance and 100% of pension contributions.

    It is a flat rate of 15% of this net income of 1 child, 20% for 2 children and 15% for 3 or more. However, if the NRP has children living with him, there is first a reduction of 15% for 1 child living with him, 20% for 2 and 25% for 3 or more, which means you will get the relevant percentage for your children on what is left after his reduction.

    There is a flat rate of a fiver for very low earners or for those on benefits, which is a fiver more than under the old system.

    If your child spends only 1 night per week with the NRP then there is 1/7 reduction on his maintenance. 2 nights gets 2/7 reduction and so on.
