    Those regs only apply to new cases, so you will have a case - if he refuses to provide her details, they will apportion 50% of the housing costs to her as a default :rotfl: so if she earns less than him it should prompt them to providing the details in order to apportion correctly in their favour, but you will still get something.

    If she earns more than him then if they still don't give her details it will remain at 50%:D
  • My hubbie has just got a letter from the CSA, to say he has been assed. The calculation is wrong as it does not allow for the 2 children in our household. Wow we have been allowed £17 for our children!

    Anyhow, he prevously paid under a court order and has never missed 1 pymt, his ex left him for another man and is not on benefits.

    Can they over rule the court order?

    Can anyone tell me if I move in with my girlfriend will it affect her csa claim. She's been chasing her ex for money for ages and finally they've put an order on his employer to take money from his wages. They reckon she'll deffo have money by march at latest.

    We've talked about me moving in but she's worried that this will mean that things get held up again with her claim if she has to let them know a change of circumstances. I'm self employed and pay myself a small monthly wage as work is not regular at the mo. Also anyone know what security I'll have if I move in as house is in her name,

    She doesn't have to mention you at all to the CSA, her claim won't be affected or held up if you move in. The only people that need to know about you moving in are the Inland revenue (if she's on benefits), :beer:

    the rp has bee offered money by us but says its not enough

    even tho we thought 100 pound a month fair conciderin she
    tricked him in to having the baby she thinks he shud support the baby fully an pay for absolutly everything

    so now its going to the csa

    its good in a way as we can get a dna test done at an affordable rate

    but im so confused i wont mind giving my details if i have to and i do have a child that i dont recieve any csa for

    i understand that as we live together that a certain % wil be taken into account but how do they allow for normal living expenses such as rent c/t loans an car maintenance

    we have around 280 per week but the rent an c/t tops to arround 140 leaving us with 140 to live on an pay all the other bills

    i did one of those assesment things on line an it says we will have to pay 49 pouund it this rite as we really cant afford it were allready in a lot of debt from xmas an im really worried

    dus any one know fully what all the allowences are if any and will they take the car loan in to account an its maintenence as no car means no work an no work means no point in assessin us cos there will be no money

    any help apriciated an i have been on both sides of the fence so to speak

    Is this the first time you've been contacted? Is it a new case?

    If the assessment doesn't include children in his household, you need to have him phone up and get it reassessed (which they have to do.)

    With the court order, it depends when it's from, but no harm in telling them you have one, and if the payments have been made up till now, tell them that too.
  • If csa payments were eg £50 a week, and you could litrally only afford eg £15 a week, would csa lower payments?

    If not, you could lose you house and have 11000 - 15000 debt, may have to declare yourself bankrupt, therefore child/children would get nothing.

    ???

    doubt it as maintenace will be your first priority and they dont allow for debts, the only way your might get a reduction is if your wages go down, ring them up anyway and enquire :)
