Block Caps Kelloggs36: WELL SAID...especially your quote -

The PWC is always the one who suffers, or rather, the child does as the child gets absolutely nothing because if the PWC and child should lose her home due to the maintenance not being paid then that is just a shame, but lo betide if the deliberatly refusing to pay NRP may lose his home - that is terrible and must be avoided at all costs!

Sorry if this has been mentioned before but i've been lurking around for a bit and can't find out much on this topic.
Is it just me or does anyone else have a problem trying to get money out of an ex, for the care of the little ones? Don't get me wrong but i do get money monthly from an ex, but in the last year alone it has gone down by £100 a month (just covers dinner money per month now!), How on earth does the ex afford to have holidays in 4* hotels, new house, new extension on house, new partner, and then pay peanuts towards the care of the children??
How are we to gain evidence on them and their income?
Detective work isn't my strong point, but if that's the way it got to be then how do i do it???

Need more details! What is his assessment? What is it based on in terms of earnings? is it old or new formula? does partner work? Do you know how much she earns? How many children do they have in their household? What is their mortgage? This can be easily got hold of from Land Registry provided mortgage was in the last 7 or 8 years.
  • You need to ask for another reassessment, you say that your assessment has gone down~ is that because your ex asked for a reassessment on lower wages ? Could his wages now have gone back up ? Report to CSA that he also appears to have a llifestyle inconsistent with earnings declared.

Please also remember that if he has a partner they might be a high earner ( hence the holidays etc) but this will only be considered in the assessment if you are on the old rules.

That's why we need more details - to determine if there is a case for Lifestyle inconsistent with declared earnings. It is extremely difficult to win on this as there has to be so much evidence. What is his job? does he earn much below what is expected for that type of job?

    My guesses -
    1) He has a new claim against him.
    2) Any shared care involved?
    3) Is he self-employed? (Most likely answer.)

It's under the old assessment and i'm the one trying to get more out of him. Payments used to be in excess of £250 per month
I have two children under 8, found out that he earns £18.000-£20,000.
Don't know how much his mortgage is for exactly (but it is around £40.000) as he has made money from property.
Know that he and his partner share the mortgage.
CSA have asked for evidence of the new partners name, date of birth, place of work etc as evidence.
Wages and living costs for him are included in the summary but hers are not taken into account, as again, i have no evidence to show that she lives there. They do not have any children living with them, but do get the children to stay for overnight contact once a week.

Thanks, have told csa that she lives there and they sent me a huge booklet to fill in which included answering loads of questions on the new girlfriend, how am i going to find out where she works, her full name, how much she earns? Stalking seems to be the only sensible answer! :rotfl: :rotfl: :rotfl:

  • You say that the CSa are asking him for info re: partner ~ what have they done, have they got any info or still waiting? Csa need to be sending him warning if he is ignoring them. As if he won't provide details then an Interim assessment should be put in place, CSA can check if anyone else is registered living in that property, if he claims no partner is living there get Csa to check if he is paying single person occupancy on Council Tax ( could have evidence of bill in file ) If he's not what moneysaving person wouldn't be if they were living on their own ?!?
