My dd's dad and I came to an agreement so he pays me some money each month and we have never had dealings with the CSA.
With the boys' 'father' he paid up for a while then ducked and dived to avoid paying at all costs even once denying he had kids. @hole.
Physically, mentally, morally, we are better off without him! Just not getting anything financially, but tthe way he saw it kids are like some pay per view channel if you pay maintenance it gives you the right to see them, even with a history of violence and so on...

  • Hi, i have just joined to get some advice for my brother. Here goes.....

He has just been told by an old flame he has a 12 year old daughter! He is in the process of arranging a DNA paternity test and she and the guy that has brought her up are now saying they are going to contact the CSA for back dated payments for the last 12 years. Is this possible? He didn't even know about her until 2 weeks ago!

    Thanks

IIRC payments can only be backdated from the date that the claimant contacts the CSA.

The claim only starts from the time the PWC makes a claim, unless she has made a claim previously and they have not been able to trace the NRP.

I assume that as she has found him relatively easily now he has not been that hard to find?

No, absolutely not possible. Money would be due from the date that the CSA contact him (the Effective Date of the case), either by phone or letter, and no earlier. A non-resident parent has to be informed that there is a claim, before they are liable for any money.

as i have worked for the csa for nearly two years here is my suggestion to you
complain ( im sure you have but do it agin in writing )
wait four weeks and write agin to complain (if you only complain in writing the once it'll go to the bottom of a massive pile )
secondly write to your local csa office you can call them and get the address and in your letter state that you wish to see what notes they hold on your case on there system this will show your conversations
please contact me when you have this and i will advise of next steps if you want but please be aware that until you complain a few times they will not even look at it i assure you
and i know it is difficult but please do not get stressed if i can help you deal with this situation in the correct way i will do
    take care

I'm looking for a bit of advice please.

I have 2 children who live with me. My ex and I have a very good agreement with regards to maintenance and access and we've never had any problems.

He has a younger child by a partner he split up with earlier this year and she has got the CSA involved in their maintenance row.

I got a letter from the CSA requesting details of when and how much maintenance he paid for my 2. I assumed that this was because they needed to take those amounts (less than what they would take from him, but an amount I'm happy with as I earn more than he does) into account when sorting his case out with the other ex.

I got a letter from them on Thursday saying that as from next month THEY would be handling my maintenance and not to accept any cash from my ex, it also asked for lots of details about my salary. I rang them up to enquire about this as I don't see why her trying to get at him should affect me and my 2. I was told by a rude person on the phone that if I didn't let them handle it then they would not take the amount he pays for my children into account when working out his other claim and therefore he'd probably not be able to afford to pay me anything. She also took it upon herself to tell me that with his earnings he was being very cheeky with what he paid me and I should be happy that they were going to "get" me more. She basically said I had no choice, but to allow them to deal with the maintenance.

I really don't want this. I don't want the money upped because what he pays me isn't just all he does iykwim - he works a lot of his time with the children around my working hours so that I don't need to pay for childcare, he buys certain things (like shoes for example) amongst other things so I don't see the need for anymore money. We are happy and comfortable as we are and I don't want the hassle of the CSA (having seen how mince they were for my Mum when my Dad didn't pay a single penny).

Do they have the right to insist on dealing with our maintenance and say that if I say no they won't take it into account when working out his maintenance for his other child?
