SHould I go for a REMO now as my ex is in the USA AFAIK but he definitely has assets in the uk, quite a lot of assets in fact. Just been to a CSA appeal today and they have closed my case, that is what I was appealing about as they have not got proof that he is not just a temporary resident in the USA.

I don't think assets in the UK have any bearing - it's just if he's living there (and more importantly earning money there). Frankly, you've got nothing to lose by going down that route, except that going to Court in the first place could cost you.

  • Hey guess what?
Government agencies move in mysterious ways...
The CSA phoned this afternoon regarding my complaint which they have been looking into for months.
They are going to make me a 'conciliatory payment' Ooh I wonder what that will be?

Have you applied for a 'variation'? They will investigate her circumstances in this case and base the payments on her ACTUAL income not her 'assumed' income. You have to have plenty of evidence.

no i spoke to my case worker yesterday (after 5.5 mths!) he said she is claiming to be not working and not claiming any benefits which would result in me getting nil assessment. I have told them who she was working with earlier in the year and she must have some income as she has a posh lifestyle - expensive cars, hols etc. case worker suggested to get a face to face officer as the only next option left. I have no other evidence as NRP lives quite far away from me.

Apply for a variation - a Tribunal will ask more pressing questions than the CSA regarding her ability to afford to run cars, pay housing costs etc.

Oh sorry I jumped the gun a bit. You will be refused the variation and will have to appeal. You will need evidence.

    what timing!

So is it better to let the officer visit or ring tmem and ask for appeal or variation?
Also how do i get evidence? i was hoping they would use their powers and check what NI and Tax she is paying as proof of earnings.
