Noise-what does the law say?

Currently renting and we have had "drum and bass" aka "racket", all night from upstairs. This is obviously unacceptable but what exactly does the law say about excessive noise-time wise especially-is there a certain time at night/morning when music etc should be switched off-forewarned is forearmed! Thank you.

The law says 'have you asked them politely to shut up'.

If you haven't, then why are you complaining here. Do that first.

My point is that you need to ask them first or the law doesnt apply!

    Have you asked?

Environmental health deal with noise. During office hours. If it's constant then they may instal sound recorders.
You should probably ask them to turn it down first.

What's the situation? Do they rent? Do you?
  • Speak to your Local Council - the Noise Pollution team in Environmental Health and they will be able to advise you. I think the first thing they'll do is send a polite letter to your neighbours. If that doesn't work they'll ask you to keep a diary/log of noise, etc. A last resort is a 'noise box' which records noise. I'm not sure there's actually a specific time that's considered 'acceptable' to make noise but I'm sure they can advise you.

    Hope this helps:D
Many lovely wins over the years - thanks to all that post:A
  • Here's an answer re this...asking isnt part of the law...as it may not be practicable to ask...

There is no time limit for loud noise and no acceptable time for it to be turned off or quietened down.

You need to contact your local council, there should be a number that can be dialled 24hrs....you may have to call your normal number and listen to the message out of hours and it will give a number for the Environmental Health Officer....They have all powers to deal with noise and can advise you on an appropriate course of action.

Thanks. They are all very young and sharing the rented flat above us. We are borrowing the downstairs flat from our brother in law until our house sells. They have been fine until recently-think someone got a hi-fi for xmas! Don't want to cause problems for my BIL so just thought a quick note reminding them of their obligations as citizens might be enough and that timings would help.I am sure i have read that excessive noise beyond 11pm is regarded as anti-social behaviour. I know taxi drivers here aren't allowed to use their car horns outside houses after 11-maybe thats what iam confusing it with? Do different councils have different bye-laws about this?

well so far you havent said you have ;) , most people operate on an ignorance is bliss basis, so if you havent let them know, they dont even know its an issue, give them a knock, let them know its loud and its getting to be a bit to much, and take it from there.

depending on their attitude & yours things can usualy be worked out nice and amicably. in this case as its you doing the aproach, dont knock on the door and have a rant at them. dont go up their and warn them, just give them a polite knock and let them know you hear it, and you feel its excessive.

i think the 11 pm thing is more about diy, where their may be a short term excessive noise problem, but not something that if not kept in check would end up being a lifetime - like music.

i find these issues to be a rather sad refletion of the way society is, people who would rather put a note thru somones door, than talk face to face, people giving total disregard to who their noise might bother, living underneath, on top of, or next to people we dont know, and dont even bother to take the time to get to know or want too anyway.
