    Unfortunately, yes it's a contravention. Same happens when you are at the front at traffic lights and a police car flashes you to move - although a clear instruction from an an officer to do so is a defence.

    for the bus lane situation. yep, appalling. An Adjudicator can refer it back to the Council for reconsideration of discretion but they are not obliged to cancel.

    Partly everyones' fault.

    a) Emcy drivers should use the bus lane ideally - but -

    b) if the few vehicles immediately in front of you pull left into the bus lane you have no choice but to follow - I understand but it's no excuse.

    c) drivers failing to read bus lane operational times - my pet hate! Saw a case were someone got PCN for pulling left into bus lane for police car - had to because as described above, leading cars already had. Problem was there were two oncoming lanes one of which was a bus lane but not at operational times. Police car should have been able to use the oncoming lane to overtake - but of course couldn't because all oncoming traffic was in that outside lane - unnecessarily so.

    I agree. Law needs changing!

    Well I said earlier it was madness to rely on a solicitor! On second reading it's worse!
    The contravention, from what you've said is '47' Stopped on a bus stop or stand.
    That is the correct description.
    What kind of wierd logic is that? Waiting is parking. Whether you leave the vehicle or not is no definition of either. How can you possibly be 'waiting' without stopping! ?

    With Reg 10 PCNs like this there is only one shot at appeal to the Council. Sounds like all possibilities of non-compliance issues may be ignored along with the signage possibilities raised by myself and 'Bogs'.

    Then follows several months wait, at current evidence, to get a hearing at PATAS.

    Suit yourself! LOL.
  • Is your sister a solicitor specialising in traffic contravention?

    You do not have to leave your vehicle to be classed as stopped nor waiting. For example a double yellow line legally means "No Waiting At Any Time" but if you stopped on one and remained within the vehicle (doing nothing that exempted you) or left the vehicle for other than an exempted reason, it is still classed as waiting.

    In London you are not permitted to "stop" on red routes and again whether you leave or remain in the vehicle, unless an exemption applies, you will be penalised.

    It is possible that you may not have to pay this charge but you need to take photos of the bus stop markings as well as any signage that was present and upload both sides of all the paperwork you have received.

    Many PCN's are not legally enforceable but because people can't be bothered to put a bit of effort in such as taking photos they end up coughing up £100 or more when taking a few photos would cost perhaps £1.00. Are you one of these people?
