Please help, desperatly worried

We have been on a DMP with Payplan for 4 months.We have about 11 creditors.Most have been ok, sending lots of letters and defaults ETC.And making threats of legal action.

Today we recieved blue court claim forms from Incasso(tesco loan).The loan is a joint loan with my wife yet incasso are only chasing me.In novemeber myself and my wife had a letter from tesco saying they will accept payplans offer of reduced payments. But just 2 months later they are doing this via incasso.

I have spoken to tesco who say they havent sent me a letter accepting payment,yet i have it in front of me with a seperate reference on it.I have also explained this to incasso,who dont seem interested.I even faxed incasso copies of the letters.

I have not asked any of my creditors from copies of CCA's , should i do this and is it to late to ask tesco / incasso for it. If it wasnt to late who would i send the £1.00 to.

I rang payplan today and they advised me to send the forms to them and they will fill them in and forward them to incasso, I have done that today but what if payplan dont send them.

I felt good when I had my lightbulb moment and contacted payplan.It was such a relief to be dealing with my debts.I now feel more desperate than I did before my lightbulb moment.

I work 70 hours a week just to live,whats the point.Maybe im over reacting to the ccj thing,but i havent read about many others on dmp's with ccj's.

Could somebody kick me into gear, please

  • If you have the letter then there is not a lot else Incasso can do about it.They are just trying strongarm tactics.
    It is probably best to avoid confusion with phone conversations, it would be far easier for dca's to confuse you and try and make you pay more..which i am sure is the wrong thing to do on a DMP as you have to treat all creditors fairly.
    If they ring again, don't answer their questions and request that everything is in writing. If they do get a court date, it will honestly go against them as you are being responsible and setting everything up as suggested by Payplan and are budgeting to your means. The court would throw it out as there is little else they can do at this stage.

    I would also add that when you go on a DMP it affects your credit rating anyway and so a CCJ and DMP would really have little effect to improving your score (if that makes sense) It is horrible to think about I know, but there will be an end to it in the future and you will have your life back..
    Let Payplan handle them.

    I'm on a dmp with CCCS at the moment. I'm not really up on court stuff since I've, as yet, not that threat.

    However, it sounds to me like it is a threat to get you to pay more (never heard of Incasso btw - and I know most of the DCA's believe me!! - might be a new "scary" name for Tesco in house collections). If it does go to court, it's likely that the courts will see that you are making an effort to pay your debts off and fix your payments at what you are paying now or less.

    You could ask your creditors for a CCA; however, in my case I've found it opened a can of worms, in respect of them getting nastier. I've not had one enforceable CCA sent to me yet, but I am still paying them as it puts me in control of the debts and not the creditor. Every time they try to get nasty, I remind them that I have an uneforceable CCA and they go away and leave me to paying what I can afford.
    Debt 30k in 2008.:eek::o Cleared all my debt in 2013 and loving being debt free :)
    Mortgage free since 2014 :)
