    Because you will be trying to default on your debt. Dont you think that the creditors will notice this?

    yeah i understand that...all im doing is legally changing the agreement..im not defaulting in anyway

    Come on Bodi, you're not interested in finding out the finer details of your original CCA, your hoping that you find your loans are unenforecable.
    Most people who want to find that out are unable or unwilling to repay their debt and are looking for a way out - but you've already said that you can pay. The CC will take a dim view of your asking for this information even though its your legal right to do so and you can understand why.

  • I am currently having my cards contested. I have spoken to a legal representative and whilst your card is in dispute and you continue to make monthly payments then nothing is placed on your credit file! FACT. It is true that the courts have a wide range of power and in certain cases they will quash the debt but this isnt always the case as it depends which part of the law your creditor has broken. There are no moral high grounds involved with this issue or if there is then it placed on the Lender for not complying with the law.

    I was sent the email below yesterday with the subject header the same as the title of this thread by a friend. He seems to have forwarded on the main body of the email, with the first paragraph being his addition to the email. Obviously my intial gut feeling was this is impossible. I also questioned my friend on whether it was related to IVAs in anyway and he said 'no'. Now i know Martin says that if something sounds too good to be true, then it probably isn't true, but have a read, and please let me know if anyone else has been sent this, and what the hell these amazing changes to the Consumer Credit Act 1974 are????
