Hi everyone, just to let you know how I got on. I have a bankruptcy number but I also have a question which I hope someone can reassure me about too, will tell you how I got on first.
I got to the court at 10am, went through the metal detector and the woman checked my bag! I had forgot to get rid of any rubbish in it so it was a bit embarrassing! Anyway I had to ask where to go and got directions to walk up this big ramp to the second floor. I had to stop twice going up the ramp as I was very stressed at this point so was having a bit of a moment!
Anyway, I found the right room, gave my name to the usher and sat waiting to see Welfare Rights. I had to wait about an hour and there were a couple of other people waiting too. I went in and saw a lovely man from welfare rights who checked over my forms for me and scored out the bits not relevant and got me to sign in the right places, he had a quick look at my soa and said that I could have had £80 per month for holiday for a family of 4 :eek: instead of the £40 I had put. But he seemed glad I did not have a big surplus. He was very nice and very encouraging and seemed happy my forms were all straightforward enough.
He explained that I would not see the judge and took me down to see the clerk who got me to swear the oath, signed all the forms too and stamped them and gave me my BR no. and I paid the fee. She copied all the forms for me and gave me a receipt for my money and that was it really.
What was really good is that the lovely Welfare Rights man said that he would personally be writing to all of my creditors with a copy of my BR notice since the OR is a little slow to do this sometimes! :rolleyes: This is really good as I don’t have to worry about it then. He also hinted that because I didn’t have enough for an IPA on my SOA that I would most likely get an early discharge but I will wait and see on that one. He explained that my OH could buy the BI in the house which would cost £1 + £231. He said that the OR would contact me shortly but did not say when this would be.
When I got down to the clerks desk, there was a man there trying to pay his BR fees with a debit card and the clerk had to say four times, “cash only” so he had to go away and try get the cash out.
Now here comes the bit that puzzles me because it is not like anything I have read on here. I did not have to see the Judge, but what the Welfare Rights man said to me is that the Judge will not actually see or sign the petition until the next day and that I would be sent the official copy of the BR notice in the post once the judge had granted the petition. Now this is what is worrying me? Have I gone through all that and paid the fee, and what if the Judge now rejects my petition! Am a bit worried about this so would please like some reassurance that I haven’t gone and sat through all that for nothing and that my BR will definitely go through??? _pale_
And also, since I have not spoken to the OR – I haven’t been able to say that the coop account is my post BR account and that I would like to keep it. What should I do about that?

The whole experience was actually quite calm once I got into waiting room and the court staff were lovely. So I was really nervous at the start but it was absolutely no problem at all after that, thankfully! :j :j

Well done Donna! Glad you survived to tell the tale. Sorry can't help you with your queries, being a novice at all this but surely the worst is over, going to court is awful, i had to go three times last year when i was fighting the reposession order and, although the people were all lovely, it was horrible knowing that i was in a court.
I wouldn't worry, you've got a br number which kind of makes it official, surely the judge can't ask for his number back .

hiya Donna well congrats for getting through it today - it is lovely to hear court people were really nice! I cant answer you either unfortunately mine isnt till Friday but will let you know how I get on then (and OH cos he is doing it too!!!).

I would not read into it too much... I did not see the judge I am pretty confident both the welfare officer and the clerk would not have progressed with the forms if the Judge was going to reject it...they deal with 100's a week and possibly more in todays climate.You obviously have had the forms checked sworn the oath and got the BR number etc the stamp is just a formality it is probably due to the judges workload...the clerk would not have progressed with the paperwork if they saw a problem that is what they are there for.
The main thing is you have done it.
I cannot see any problems with your co-op account when you get your OR interview they will probably have no interest in it whatsoever I explained to the OR that I set the account up 6 months before because the Halifax wrote to me threatening to take money out of my account for a large Halifax Credit Card balance which was on reduced repayments. The OR said that was a very sensible thing to do to set up a seperate account and due to a tiny balance in the account they had no interest in the account whatsoever.0 -

Ohwell, I thought that I would be at least less than number 10 given that today was only the second day of the year that the court had heard BR petitions, the first day was actually the 2nd January so I bet they must have been really busy the day after new years day! :eek:
Also and this will tell you what the court is expecting. My court only currently operates a drop in service three days per week....... next week they are starting to offer the service - all five days a week!

There will be so many more. There has been a huge increase on here alone. Its the way things are going. Hopefully card companies and banks will check people more in the future instead of ramming credit down our necks.
The cost of no more creditors phone calls and letters, "priceless".......:rotfl:0
