  • is this working
  • It's working.

Not sure if you'd be allowed the discount, I would have thought you would be, a quick call to the council should clear it up, I've chatted to my local office a few times and they're always helpful
  • I tried to explain to the woman in the Council Tax Office, but honestly it was like pulling teeth. Since then I have spoke to our accountant at work, and he has helped me with a formal letter explaining the situation, they have to respond in 14 days so should hear back soon, will keep you all posted of this outcome. Thank you for replying.
  • Good luck with that.... sometimes the powers that be make life so difficult it's no wonder people will just tell them the house only has one occupant and leave it at that!
My house was left empty for a period of time, I made a phonecall and told the council about it, they just sent out an updated bill and left it at that.
  • Hi

Local authority will decide whether this property is classed as your husbands 'sole or main residency' and to be honest from what you have include on the noticeboard I don't think they will grant you an SPD. You class him as your hubby and I am presuming all his mail goes to your home address. Friend in similar position and wasn't granted an SPD.

Council Tax legislation in this case will almost certainly deems this to be his 'sole or main' residence. There has been case law regarding residence abroad which usually rests on the basis that the person would return to the family home if the job ended or they otherwise left the employer.
I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
  • He does still have his post here, but has a permanent address abroad, the HMRC have declared him non-uk resident, I send his post to him. Would the above still apply, your thoughts would be appreciated.
  • Hi

I think the council will still regard him living at your address.

Tax residence has no bearing on 'sole or main ' residence decisions.
