CSA - can they take money that's in my name to clear my husbands debt??

Kelloggs is right. The mother would have brought up the children and deserves to have been given money for the childrens upkeep.
The ex-wife now won't get a penny now though, however much you pay.
Thats why a private arrangement is so much better. you pay 20% or 30% through CSA, how much of that goes to the mother. That's the system, I guess.0 -
What do you mean that the ex won't get anything now?0
-
sorry, didn't know.
Do they get percentage of arrears?
if the child is now grown up.0 -
They get ALL the arrears - for example, my ex owed almost 29k arrears and my daughter's ongoing case was closed as she reached 19 years old and I got £25k lump sum and am getting last £3.5k in dribs and drabs.0

If they were on benefits?
sorry, Thats what i mean't.0 -
Not if they were on benefits!0

Wow! so my ex has been getting (almost) nothing?
If ex allowed me to keep my farm, there would have been no CSA and state benefits. There would have been enough money to go round. The CSA is unjust, oppressive and discriminates men. If you tell me otherwise then 2 and 2 is 5, and you have a Ph.D in rendering bovine fecal matter.0 -
If he had never paid her in the first place I would agree! She did not pay for their upbringing alone - my husband always paid her, just in cash so he can't prove it, and anyway both of the kids lived with my husband for at least half of the time! I understand there are a lot of bad fathers out there who don't want to take reponsibility for their kids but my husband is definately not one of them!0

Very similar.
Its the one that don't bother that get my goat, but some did pay cash and can even prove it.
The line "you should tell CSA of all change of circumstances" comes back to haunt many.
Trying to find out if my ex whilst on benefits without declaring I did pay her, is worth examining though.0 -
Couldn't agree more, there are some out there who don't give a hoot about their kids or paying for them and they should be hounded by the CSA, but like there are bad fathers out there, there are plenty of vindictive ex-wives too, who think that screwing a decent bloke over is a fabulous hobby to have!0
