in Credit cards
Hi, Can anyone help, I recived a credit card from MBNA Approx two years ago, I had not applied for it and have never signed an agreement for it, When it arrived I rang MBNA to ask why ?, They said they had no record and could not find my address, They asked for the card number and my address which I gave, They then said they had found me and would activate the card just in case I needed to use it and that I had a £10'000 limit, I again stated that I had not applied for it they asked if I had been on hoilday I said yes they said I must applied at the airport I informed them that I had only been to Cornwall, I was in a lot of debt at the time (as I had been made bankrupt a few years before when my companey colapsed) and used it to pay that off as the interest rate was ok then, I now find that I am paying £280 a month all interest nothing off the card, I have asked them for help with the intrest with no joy, I have also asked for a copy of any signed agreement (Knowing they don't have one) Also no joy they just say they will pass the request on to the relevant department but noyhing has arrived over the last 12 months, I have had the money and do want to pay them back but it is impossable, Can anyone give me any advise,

Hi Steven,
Welcome to MSE
I would imagine that the best thing for you to do is to contact MBNA with a payment plan and ask them to freeze the interest whilst you pay it off. It would probably be best to go through one of the free debt charities like CAB or CCCS. They will more than likely require you to fill out a Statement of Affairs which proves how much disposable income you have to service this debt.
Firstly I would hop over to the Debt Free Wannabee board as they have wonderful people on there with a lot more information on the process of freezing the interest so that it gives you a better chance of paying the debt off. But, the downside of having the interest frozen will give your credit rating a battering I'm afraid.
But well done on owning up to your debt and your willingness to pay it back :beer:0 -
Can you please confirm - you received a card but claim not to have applied for it? (They tend to be outside venues where there are large crowds with application forms such as Old Trafford anything like this ring a bell?)
Who spent the money on the card to make you pay £280 per month?
If it is a case whereby you have spent the money but now are looking for a getout clause expect no sympathy from me.
Going to the debt free wanabe forum is good advice.0 -

As I said I spent the money, And No I did not appley for the card and have never signed a contract, ( No chance on me being outside Old Trafford, even less of being inside ) I am not trying to get out of paying I fact I am paying but nothing is coming off the card,0 -

Doubt you'll get sympathy from jonesMUFCforever whether you intend to pay back or not ?
If you have requested a CCA (Consumer Credit Agreement) and they are unable to supply one the debt is unenforceable.
Thankyou, I think I will send them another letter, asking them to freeze the interest for 12 months, But if they do not respond or refuse what do I try next ?0 -
I almost spat my tea out then when I read someone has a card they didnt apply for, maxed it out, and then wants to pay it back. Has the world gone bonkers?!0
