Dial A Phone contract with O2 redemtions !

I have a contract with the said company and i have to send my bill each month to a claims department to get my cashback, I have recieved 2 emails notifying me that they will be crditing these to my account but nothing has.

Has anyone had a simular experiences ? whats the best plan of action ?

Though it sounds obv to just call dial a phone and ask, if it seems that simple it rarely is !

  • In my experience O2 send you a statement telling you your account has been credited but this does take a while.

    ok thanks, will wait till next months statment come through then will follow up

    it really is annoying i'm having to fork out the full amount each month when I should only be averaging 4.99 a month at the moment
  • My contract is with dialaphone/3 and I have had no problems with cashback from either of them - 1st 3 months cashback from 3 was fine and 2nd and 3rd from dialaphone (though I got a little muddled!). I got a text message for 2nd payment and was credited to bank a/c straightaway. Got letter for 3rd payment and this was credited to bank a/c within a few days.

    I would check bank a/c and details you have provided to dialaphone just to be sure and then if haven't rec'd anything within say 5 working days, give them a call to double check.

    Oh mine say they are going to be credited to my bill, should I be asking if I can have them credited to my bank account ?

    phoned them up again to today, they owe me £30.03 45.00 and 50.02

    Ah well If all else fails i'll go along in person and ask for a cheque.

    My hubby had exactally the same problem (hes called Russell too you aren't him are you?)
    they've owed him quite a bit for the last 3 months keep telling him theres a cheque in the post but never recieves one, last time he rung guess what they said?? theres a cheque in the post :mad: :mad:

    sounds like he will do well to get it too, I did see a bit on watchdog several months ago about these mobile deals.....

    heres the breif of my situation, they will be dealt with(I now have plenty of time).......

    I have a contract where by you have to send in your bill to get cash back on your bill.

    they are failing to now honour these payments to my account as the phone was disconnected, then reconnected.

    they say their 'air time agreement' (contract) states this and it sure does.

    however the failure of them not paying these credit back to my account to count as payment is the reason the line was disconnected.

    I intend on sending them a letter explaining the reasons why they should pay me the amount of £30.03, £45 and this month £50.02 and honour payments in future months, but is there any such law that I can quote.

    I suppose they are penalising me for breech of the contract, so could I quote the consumer contract regs ?

    the total sum of cashback I should recieve is about 200 quid, I also intend on contacting trading standards as they said it was 4.99, but did not find out I could only have it a 4.99 by redemption cash back deal....(you only find this out when you break the seal on the envelope, which does not entitle you to change your mind).

    to say they are annoying is an understatement

    also, Looking back to the original agreement, it states they will refund the money to your bank account - somwhere in the mist they change it to putting it on your next bill. They tried to tell me o2 where rejecting the payments first of all.

    Looking further down its seems like some people have had to resort to the small claims route.

    Looks like I need the address of someone at DIALaPHONE who will take notice of a demand letter I will be sending them tomorrow.

    Any one who has the MDs address please post it, thanks.

    CALL OUT anyone who has taken court action against a company regarding cash back redemptions/terms that are not valid, please post here thankyou.

    With these cashback deals, you always pay up front and claim the cashback from these 'dealers' afterwards. T & C's say you must pay the netwrok provider and all bills must be paid up to date.
    From another post you have re Mobileshop, I don't think you understand the rules of this cashback game.

    I understand the priciple, however it was not what I had agreed persay at the time of contact.

    NO MENTION OF REDEMTIONS, only the fact that I would be paying 4.99 a month.

    Now they have to prove that I had agreed to the contract and the term exsisted at the time, not afterwards.

    Can you understand now, therefore I thought the redemption process should be simple. Now as they did not credit the first redemption my account was still owed.....no fault of mine, they should of credited over 70 pound.

    This caused my account to be suspended, then had to pay up the amount due, now after this the company in question says they never recieved the bills in the post for subsequent claims.

    This means they are using a unfair term in contract to pay 600% more than the cost agreed to at time of contract.

    I was simply asking has anyone bothered to recover the money in court ?
