I brought an orange SPV C550 pay as you go online from comet for £109.99 with a 512 meg storage card, however when it arrived i first noticed that they had over charged me and then upon closer inspection the phone only had a 128 meg card with it :mad: , so i phoned up comet (0870 number) and was on the phone for 45 minutes :eek: and they said that they would sort it out by tommorrow, i waited to no avail so i decided to contact the complaints department who assured me that they would sort it out asap i waited yet another day and ended up phoning them back again, and only to be told that this phone only comes with a 128 meg card now yet it was being advertised with a 512 card ( below is the printout of the original webpage that i ordered from) basicially the only option they gave me was to return the phone for a refund, i tried to explain that i am happy with the phone just uphappy with the fact that they advertised it with a 512 card and sent it with a 128 card since i have complained they have now changed the webpage LINK HERE to the original webpage which is below
as for comet saying this phone only comes with a 128 meg card it doesnt as orange online sell the same phone with a 512 card for £10 cheaper but they were out of stock :mad: so i ended up getting it from comet, and comets wording on the advert was identical to the orange one
i would just like some advice as to what rights i have in this matter if any any help or advice would be appreciated

I would of thought that that is a matter for trading standards as when you purchased it they advertised it with something different to what they sent to you withWeight Loss - 102lb0

OK, here's the outline of a draft letter to Comet. This assumes that what you want to achieve is an apology and your costs back. If you set your costs at a realistic level you should be able to get some money which you can then take to Orange when the phones come into stock again. I don't think you can force Comet to sell you a 512 meg phone, although your chances of this would be increased if you found they were selling them (at a higher price). Can they send you a 512 card to slot into the phone? (not sure how these things work) - if so, you might want to change the wording a bit.
Dear Sir or Madam,
On (date) I purchased ......The attached page shows a printout of your advertisement, which clearly shows that this product has a 512 meg storage card.
The product I have received has a 128 meg storage card. I note that the wording of your advertisements has now changed.
My telephone calls to you have not been returned, and timescales given to me by your staff have not been adhered to. In addition, your staff have told me that this phone is not available with a 512 meg card - clearly false, as the product you originally advertised, with this larger card, is being sold by your competitors. I have had to telephone an 0870 number at a cost of (insert cost) per minute, and wait in for calls which were not returned. My total costs to date are £.....
All your staff have suggested to date is that I return my purchase for a refund. No proposals for reimbursing my costs have been made.
This letter is written to give you the opportunity to refund my costs (and send me a 512 meg card???) without recourse to small claims court action, which I will start on (insert date - maybe end Jan?) if no reply is received.

If you are sending a letter asking for costs back you need to give them a breakdown of the costs involved which appears to be the cost of one or more 0870 phone calls (so your phone bill would be required). They have already offered you your money back and fixed the error with the web page so I am at a loss as to what else you want from them?

i wanted what they advertised, and what i paid for, an orange spv c550 with a 512 meg storage card not one with a 128 card :wall: yes they have offered my money back but this is not the point, the point being they advertised that it comes with a 512 card and i get a 128 card this is a criminal offence under the trade description acts and i wonder how many others this has happened to ???????/:beer: steves cleenz valeting :beer:0 -
It happens a lot and some people don't even notice/don't care. If you were clever enough to notice it then others should too. It's their fault for being so ignorant and not being moneysavers0

wey heyy :T :T comet are sending me a 512 card I want to give a big thank you to jobbingmusician :beer: as it looked like this letter worked with some cuting and pasting from the trading standards site, as for trading standards they said there is nothing they can do, if comet have offerd me a refund thats all they can do but hey im getting what i paid for and that all that i wanted

Who did you address the letter to?
I got a PC from their clearance store which had a lower spec than advertised and had the same response - return for full refund. I don't want a refund.... I just want what I paid for.0
