    As you can't try underpants on in the shop, if the size is not correctly stated, they are FAULTY.

    Wrong. These underpants are returnable as they are faulty. Fault = incorrect size indicated.

    Stores CANNOT refuse to accept return and refund of faulty goods.

    Think about it the other way OP, would you want to run the risk of buying boxers that someone else has worn? This should make the loss easier to bear, it would with me!

    The loss is for the shop to bear, not the customer who has been sold faulty goods.

    I've tried to return unopened undies to primark before and been refused a refund or exchange. Its gutting.
    Not as gutting however as a pair of shoes my mum bought me that dont fit. She lost the receipt and they wont refund or exchange back even though they are still tied together with the plastic security tag!!

    definitely put me off shopping there in the future.

    Thanks everyone - to be honest the hassle and cost of trying to return them means I'm going to donate them (minus the tried on pair;) ) to a friend who's son has a smaller bum!!

  • Some shops will refund! The place I work for will!
    It is within statutory rights that the item is not fit for its purpose and is wrongly described. They should fit when you buy them not after "stretching" through pure discomfort. I would have insisted on seeing a manager and asking to see a copy of their policy.
    Any decent shop however looks after its customers as a few goodwill gestures go a long way and that is how you get customer loyalty.
    Returning without a receipt is a problem as with so much shoplifting etc/buying off ebay-you need to prove you bought the item initially. However-most shops will give you vouchers or exchange but not a refund. Shoes seem to be the most difficult item somehow from what people tell me and you need to ask before you buy an item about the refund policy. Make sure that you note who you spoke to and try to speak to management.

    Think I'd donate them to a favourite charity shop and put it down to experience or you could alway try to sell them on eBay.

    If there is a label inside the pants that says a different size than what was outside of the pack, you definitely should be able to return them and show the error in packaging to an employee. If the pants don't have a size on them or the size is incorrect, I'm not sure what you can do. It's certainly something you could take up with the store home office or the company that made the undies, but unless they were really expensive it might not be worth the trouble to you.

    I've got an update on my shoes. I was told by a friend that primark were doing exchanges for xmas presents without a receipt so i took them in this week (told a little fib) and they let me exchange them with no problems whatsoever :D
