Where do I stand with returning underwear?

    It doesn't quite work that easily, fabric stretches and the will stretch it to it's maximum length in an effort to prove that the sizing is correct, and I can guarantee that they will stretch to 35 inches. This isn't a problem that will be solved in store, only head office can make a decision on sizing errors...good luck getting anywhere with them.

    You can ttake them back and ask them to return to HO or manufacturers to check they are correctly sized as your son who is a 32" waist found them too small.

    OH is a 35-36" waist and I just bought him a 3 pair pack of hipsters in M&S sale for £5. They only had size medium whereas I would normally buy him large in tight fitting pants but they fitted easily. M&S will return underwear too if unworn.

    For ladies La Senza accept returns. I was surprised to see them accepting thongs back as they are tricky to try over ordinary pants. If I was the assistant having to examine returned thongs as don't fits I would wear rubber gloves:D

    I would take them back and I would expect a full refund: the item is faulty- its made incorrectly or packaged incorrectly, measure them at home to make sure, then take them back to the store and explain they are not made correctly.

    I would then call customer services of the store if you are not given a refund. You chose correctly, the store did not sell correctly, simple as.

  • Have been in Primark when someone tried to return underwear. It was a total no go. They usually tell you when they sell it.

    Try it on E-Bay, you may be surprised. Two kinds of customer for these, one will want the unopened packs and the other will want the opened one - Tell us which sell for most. Just check your postage costs first before listing

    Thankfully stores won't except returns on underwear. Although it's unfortunate for you in this matter. Sizing does differ between makers and country of make etc.

    The store cannot REFUSE to accept the return and refund/exchange of these undeprants as they ARE FAULTY, because they are NOT AS DESCRIBED.

    If the OP's son really is 32" waste and the underpants are too small, despite the packaging CLAIMING that they are big enough, then the goods are not as described and you have a LEGAL RIGHT to a refund.

    Under your STATUTORY RIGHTS, it is the retailer's responsibility to prove that the fault was not present at the time of purchase.

    Ther OP has a right to a refund.

    The retailer cannot over-ride your statutory rights by stating that underwear is not returnable.

    If the retailer wishes to throw the underpants away rather than re-sell them, that is entirely up to them.

    They cannot decide not to refund you.
