O2 Online + XDA Mini S

Hey guys

On Tuesday I received my XDA Mini S which I ordered from O2 Online on the weekend. It was incompete and looked used when i received it - no charger/battery, open CD, seal broken/void on box etc. so I phoned for a replacement which will take '7/10 working days.' Not too impressed. O2 have been pretty awful in the past and i'm not sure if i want to risk it again.

So what i'd like to know is:

Can I return the phone without being out of pocket?
Does anyone else do a similar package - i'm looking to be sending a lot of texts (around 500)?

I'm not necessarily looking to get a XDA Mini S again - i'm not eve sure i'll like it as it seems a little big. Maybe a SE W800i, Samsung D600 or similar would do.
