New TV has scratches already Bought a new panasonic tv days before chistmas from Empire Direct. A few days a go I noticed 3 light scratches, today I noticed a lot more. Is this normal with Panasonic TV's, or Plasma TV's? Do you think I should ask for a full refund as this clearly is poor product design?:mad:

No its not normal for scratches to show. I assume when you clean the screen you dont use anything abrasive. A light dust with a micro fibre cloth is usually all thats needs
You can get scratches but they usually arent noticeable unless you are rough or use abrasive cleaners0 -

Just to clarify, the scratches are on the screen, they are not deep but very faint. We used the cloth provided within the packaging from Panasonic.:eek:thethinkingman

when cleaning the screen u should only go accross or up and down never go in circular motions that is the best way to clean it also add a small amount of water to the cloth0

Send it back, they shouldnt be there and if your within a reasonable length of time you can return it under the distant selling regulations so no need to go in to why your returning it.0

you may have trouble with this one as the scratches haven't magically appeared by themselves but have been caused by human actions ie you and Empire Direct will most likely say that you've scratched it (which you kind of have) therefore not their problem.0

Last Tuesday, my wife went back to return the TV. The main manager wasn't there, but the other sales people were there 'happy to help'. They said that if it had deep scratches they would have refunded, but they don't refund light scratches, which was ofcourse the complete opposite of what the main manager said. Because we wanted a refund, we would have to wait for the main manager to come back on Thursday.
So yesterday, Thursday, we met the main manager. He said he couldn't find anything, and therefore couldn't refund, in short some of the arguments he used:- The second TV was brand new
- You can't return the TV because it was a package purchase, you can't return the blu-ray player and stand as well
- You will have to pay a admin fee for the return
- I can't see the scratches
- Oh, the scratches seem to be only in one place
- I thought you meant that the scratches were deep, but not this faint
- You should have phoned me when you seen the scratches, not leave it for a few days
- Have you still got the packaging
- You can't say its not faulty, because the TV still works, scratches are not classified as faulty
- You can take it to small claims court, but you won't win

Yes, they may make the TV faulty. It is irrelevant that the TV works.
No, you will not have to pay an admin fee if it is returned as faulty.
Packaging is irrelevant if it is faulty.
It is not for a store manager to determine who will win at Court but the Judge. It would be a very sad reflection if Empire Direct took it all of the way to Court.

No, you can't.
Under DSR, you have 7 working days to return the item, with the first of those days being the day after delivery.
To return under DSR, you must not have used the item (it must be returned in the same condition you received it). OP seems to have obviously used it.
What he is complaining about is actually covered by Sale of Goods Act, not DSR. He is claiming that the tendency to scratch is caused by an inherent fault with the item. Under SOGA that may entitle him to return for refund/replacement.
Please don't mislead people if you aren't sure of the legislation. You could prejudice any sensible claim they may have.0
