Husband leaving me..advice needed please

My H told me before Christmas that our marriage is over and he's leaving. We have 2 young boys and have been together 13 years.
Emotionally I'm all over the place but I'm trying to sort out what I need to do financially.
He is leaving next weekend.
Our house is rented but owned by my parents. It is a legitimate tenancy and I can prove rent has been paid for the past 10 years, all above board.
I think I'm right in assuming that HB could be paid in these circumstances as my parents do not live in the house, can anyone confirm this?
Entitledto.com says I would be eligible to receive £22 pw HB, but the local council online benefit calculator says I would receive nothing. Which of these websites is most likely to be correct?
I think I will be ok with my wages, any HB I may get and tax credits but I wondered how soon it would be for these to be implemented?
I've never claimed any benefits apart from tax credits so I'm not really sure what I will need to take with me?

    You should make an appointment with your local CAB, and they will tell you exactly what you can claim, and what you should do.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    Remember he will have to pay maintenance money for your little ones.

    Have you spoken to your parents, and told them whats happening? Im not sure how long it will take for benefits to be paid, but, if you speak to your parents, they might wait a little while longer for payment for the rent.

    I rented a house from my parents and claimed housing benefit ok - there is a part on the form that asks if you are related to your landlord and I just said yes and explained.

    You should be able to download a claim pack from your local council for housing and council tax benefit - this will tell you what you need. I found its best to go into my local office with the form so they can check its right and they want to photo copy original copies of documents - tenancy agreement, bank statements (for you and your children), id etc. You need to do this ASAP so that your claim can start as they don't backdate.

    You will also be able to claim 25% discount on your council tax for being a sole occupier.
  • Yes you will be able to claim LHA if it is as you describe a business arrangement with a tenancy agreement in place. As above claim your 25% ct discount and you maybe entitled to some ctb. None of the online benefit calculators are not accurate I am afraid. You should be able to get ctc and wtc(if you do 16 or above hours).

    I hadn't thought about the 25% reduction in CT so that will help too.
    It's good to know someone has received HB whilst renting from parents, I'll just have to see if I'm eligible for any of it.

    Double check with your husband when he is leaving as you will need to get the lads luggage ready. He isn't leaving without them is he?

    Good point and great name BTW Yoni. The OP is probably more likely to know where the childrens clothing is stored :)
