The 5 day ruling only applies if your have bought your tax in advance of the expiry.

If tax expires 31st Dec and I bought tax disc on 31st Dec (by phone/online/trackable post) then I can drive vehicle for 5 working days until disc arrives.

If tax expires 31st Dec but I tax (by phone/online/trackable post) on Jan 1st then I cannot drive/keep on public highway until disc is received and displayed in vehicle.

The ruling came into force on September 1st - as shown in the link posted by sarahg1969

Not quite, if the tax has expired then the vehicle should be SORN.

A person is not guilty of an offence under subsection (1) or (1A) by
using or keeping a vehicle on a public road during any of the 5 working
days following the time when a licence or nil licence for the vehicle, or
a relevant declaration applying to the vehicle, ceases to be in force, if an
application for a licence or nil licence for or in respect of the vehicle to
run from that time has been received before that time.

If a vehicle is declared SORN, then the SORN declaration ends with the application for a new tax disc. The above paragraph is from the Finance Act 2008 dated 21st July 2008.

If the vehicle is untaxed for a period of time then I believe you can't tax it online anyway.

I had this problem last year spoke to my local police, who told me that as long as it was taxed the anpr would read it as taxed and they didn't manually check disks till mid month. she gave me her number at the time and i put that in the display as it took a couple of days to get the replacement disk sent.

its not just ANPR you need to worry about.
the DVLA have thier own enforcement vehicles, usually sitting at the side of the road with a camera in the boot and a red scrolling led sign warning of tax disc checks. this checks to see if the current disc on display is valid.
