    I have exactly the same problem. Recently I had to become a carer for my sick parent. Because I was prudent enough to pay into a pension whilst I was working I'm penalised now by this measly £300 threshold. I'm only 36 and being bullied by the HSBC for a £3500 loan.
    I asked the CCCS agent if anyone had ever challenged this pension element and he said no which I find surprising. However, it encourages me that the CAB have.
    What did the government say? And imminent plans to change things?

    I cant afford the 185 really as all my money is my student grants and loans. i have to apply every termfor extra funding from university just to be able to make these payments. i'd rather have no money to spare than keep getting the letters, phone calls etc. Also right now i'm living at home with parents which i cant do forever but its rent free. i need to get my own place in april and then theres no way of my payin 185 a month just with my grants.
    when i spoke to my employer about it their response was "just dont tell them u have a pension then". when they refused to help me i sent them a letter telling them that one of their employers (this is a very big, well known company) encouraged me to lie like this they still weren't interested in helping me. if you could get that info about it that would be great thanks alot. i really hope they are going to change it
  • Hello i currently owe around 14k in bank loans, to 2 different banks.

    After my income less all my expenses i do have less than £50 so i would be eligible for a dro. This is were the problem lies.

    Due to several family issues, i rent the house were i am living off my mam because she is backwards and forwards between our house and her partners. The house is rented from the council and all the bills are in my mams name. I pay my mam X amount a month towards the costs, but how can i prove this, as the bills are in my mams name?

    Any help at all would be appreciated because im sure if i filed for dro they would ask for proof of paying these bills.

  • i would ring the cccs and ask them about it, they are the experts and i'm sure theres something you can do in that situation
  • Hi, I haven't had chance to read through all the posts on this bit, but wondered if anyone had any advice on this. DRO is the perfect solution for me, and I fit all the criteria. when it came to applying with CCCS they asked me if I had a pension. Turned out that because I paid into a company pension two years ago, and the transfer value is more than £250, I'm not allowed a DRO. I can't do anything with my pension until i'm 60 odd (i'm 21 now), I have written to the company i worked for explaining the situation and pretty much begging them to bend the rules and either release it, or just put it back into the company. It's only about 1000, and would save me £12,000 in debt so really not bothered what happens to it. but they dont even want to know and wont help me. does anyone know any way i could get around this? right now i'm payin 185 a month to a debt management plan, my debt is around 12,000 and i just feel like it will never be paid and i want a DRO :(

    But said minister has asked for more case studies over the next few weeks, wont hold my breath, but reading between the lines there may be a a slim, very slim chance they may be wanting to squeeze any change in for april

    arrrrgh that would be amazing. how do i tell him my case study!!!!! should i write to my MP maybe?!! last time i wrote to her about something she was really helpful and passed it on to the right people. every case study has got to help?
  • Hi, Ive just finished a really long but very very useful phone call with CCCS and im pretty much decided that i need to go for a DRO as long as my letting agents dont terminate my agreement because of it! It doesnt say in my tenancy agreement anything about bankruptcy etc but im going to check anyway! Has anyone else had any experience of this? I live on my own so cant even persuade anyone to take on official responsibilty for the rent!

    has the DRO helped people? what im most concerned about is the impact it might have on me? I dont have any assets or pensions or anything and def fit the criteria for the DRO, Ive been on a dmp for nearly 2 yrs and at this rate its going to take me another 18 :-( every review the amount i repay just gets smaller and smaller, wages never go up but everything else does, so having cut everything out of my life i need other options! Im feeling optimistic about this but i would appreciate any advice! thanks!
