  • Should I be worrying? 

    Stepchange submitted my application for a DRO on Tuesday afternoon, as of now it’s still not showing on the register.  I know they have 10 days but everything I’ve read suggests that it should be done by now. 
    The wait is making me feel sick!!!
     All my debts are in a previous name to the one on the application (although my previous is also on the application as such) could this be an issue, stepchange said it wouldn’t be.

    Last year in September I finished my year moratorium period of my DRO and I am still getting letters from my previous debt companies. 

    Whilst dealing with a company (satsuma) they asked for my full name to search the insolvency register and they said they couldn't find me. So I looked and realised I am no longer on there!

    Is this normal? I am a bit worried I am no longer on my DRO and something had breached it?!

    I haven't borrowed any money or anything like that so it's confused me.

    Any advice will be muchly appreciated 😊

    So sorry to learn you are still being hassled, even though you've had your DRO granted.  I think it might depend on what agencies  your former creditors are using to see your information.  When I had the wonderful free Noddle credit report facility it was easy to see old debts, balances, DROs and all the relevant dates and I found that very comforting.  I was confident that creduit searchers could see them too.  But I just went to check what I can still see now it's changed to Credit Karma, and can't see any of those details - very frustrating.  I'm sure others on this Forum can  help you more than I've been able to, so good luck., I replied because I know how I'd feel if this was happening to me.   Stay safe, stay well.

    The DRO completes after 12 months. Your entry stays on the register for a further 3 months.
    Just send them a copy of your debtors notice and have no further dealings with them.
  • Hi I hope someone can help. My DRO finishes in November & one if my creditors has noticed a spelling mistake in the name (all the other details are correct, references, amount, etc) & are refusing to accept it.  Can the name of the creditor for that debt be changed please?

    Contact the Insolvency Service and inform them of what your creditor is saying, they had 30 days to object to their inclusion before the DRO was approved so they can't be saying this now.
    They cannot expect a spelling mistake to be a good enough reason for not accepting a DRO if the Insolvency Service say they are in then they are in it.
    They should not be contacting you, if they feel they should not be included, it's the Insolvency Service they have to convince that, legally, they are a different entity to the one included in the DRO.
    I would also raise a complaint with the creditor about their harassment when you are in a DRO.

  • What has happened is they passed it to a collection agency called Opos which somehow got translated to Opus on the DRO, not sure who made the error but I didn’t pick it up, my mental state was not in its best place at the time.  Opos must have received the DRO notification because they then immediately passed it back to the original company who are saying we know nothing about this dro, hence we are having this conversation.  Does that change anything?

    Guidance states -

    At the time of the granting of the DRO, creditors who have scheduled debts are sent a document called a ‘Creditors’ Notice’ informing them of their rights to object to the DRO. Only creditors can object to the granting of the DRO and only on three grounds:
    • The making of the order
    • The inclusion of their debt in the list of qualifying debts
    • The details of their debt
    Doesn’t mention a spelling mistake, speak to the IS as soon as possible.
