Sorry but am getting desperate now for more advice - I qualify on a personal level for a DRO, and am surprised that my OH income is taken into account. They are MY debts, not his. Does the above advice from Blind and DD mean that I should argue my case that my husbands income should be irrelevant, or should i just accept it and then go for BR.
If that the end of this I have to go for bankruptcy instead, does anyone know the waiting time for the Sheffield courts please?

Hi,
As far as I know, the OR is not interested in what your husband's income is, only yours. Your intermediary will want to know, so they can work out what percentage of the household expenditure you are personally paying for. Normally in your case, it would be 2/3 as you get twice as much income as your husband. But if your husband has his own debts, then he is entitled to make payments towards them, so presumably you will be paying slightly more than 2/3 of your monthly household expenditure.
Be careful about the pensions though - if you have more than £300 in the pension pots, you won't be eligible.0 -

My Mother-in-law went to CAB today to ask about a DRO, she was told as she is in a DMP (which she can't manage) that she is not allowed a DRO - is that correct?
She is paying £200 PM to a DMP which is crippling her and she is 77 and stressed to the eyeballs.

Provided she can't afford the DMP and actually has less than £50 a month surplus income, then she can apply for a DRO.0 -
just a quick heads up for everyone i spoke to cccs yesterday regarding a dro and was given these figures for allowances based on 2 adults 1 child
446 food groceries clothing combined
195 for car including insurance, running costs etc
plus extras (tobacco etc)
I didnt think that this information was supposed to be available to the public domain but when pressed she blurted it out lol.

My local CAB are awaiting some DRO's to go through before looking at one for my husband and me as it seems a very grey area on what the allowed living expenses will be as you are only allowed £50 excess max for a DRO
and they don't want us to pay our £90s to have the claim refused.
Can I pick your brains???? This will help so a great deal and would be much appreciated.

Do your creditors default you? Also are things like allowances fro clothes, holiday, tuition allowed?0
