Debt Relief Orders (DRO) - Information & help thread

    I finish my 1 year period for a DRO on Friday (have to say, on the whole the year has flown by and any initial hiccups (ie - people who ignored the whole 'I have a dro. stop calling me now.' message soon got it and) all calls stopped after 2 weeks.

    What happens when it finishes please? Do you get a letter or asked to see your bank statements or anything?

    I haven't been asked for proof of anything these past 12 months, no proof of statements, no balances - nothing. Only thing I've done is let them know after I got the OU grant and they said it was all fine.... seems very trusting that they believe you'd let them know if anything changed and not follow it up.

    It'll just roll over and after 3 months you'll be removed from the Insolvency register. Other than that not a lot happens!

    Dont forget, upon completion of DRO, you can start the good ol credit file clean up!!!! :rotfl:

    Here's the Insolvency Service position:
    Notification of increase in income

    The Insolvency Legislation requires a debtor to notify the Official Receiver if there is an increase in their income during the moratorium period applicable to their order.

    The legislation is in force to detect when an individual no longer meets the parameters for a DRO i.e. their disposable income exceeds the existing parameter (currently £50 per month).

    Whilst debtors are clearly required to comply with the legislation, they should not overly worry about small increases in income affecting their eligibility, as provided the increase in benefits or income does not increase their income, such that the income parameter is breached, no further action will be taken by the Official Receiver.

    What is the lowest you can owe before being able to get a DRO? I have been somewhat dropped in it by my own honesty which resulted in the DWP refusing to give me a crisis loan because I had a credit card with an available balance on it.

    Using said available balance for rent, bills food etc has left me with more to pay out monthly that I can cope with but it all only amounts to around £2500.

    No official minimum.

    I have done DROs on £2500 for people with minimal surplus income.

    Another quick question, some of the application forms I have, have a yes/no box for "Have you ever been Bankrupt?" (security and crowd management jobs)

    I haven't sent any of these back as im not sure of my position, do I tick yes and add the letters DRO next to the box? Or tick no as im in a DRO and not a bankruptcy in the traditional way? And bring it up in a covering letter or interview?

    I am so nervous, my DRO application is on the verge of being submitted to the OR after a 2 month wait, my intermediary at Nat debtline has asked for a few pieces of evidence first though. I have had an increase in child maintenance awarded by the CSA due to a change of circumstances of my DD's father (great timing!) Thing is, it's all well and good them saying I will get X amount per week (paid monthly) but the reality is something different. As the CSA point out themselves, it is all dependent on whether they get the money from him (ie if he is off sick or for any other reason and his income in a month drops, then he doesn't have to pay the full award) Basically it is NOT a guarenteed income. I have also noticed that the actual amount I get is different to what the award says (I get less) but have so far been waiting since 24th July for a futher letter from CSA containing info regarding this.
    My (albeit very long winded) point is; the intermediary/OR will take the award letter (which says higher than I actually get) to be the correct figure, and it may make the difference between sucess or failure in getting a DRO.
    The stress of all this in the last 2 months is really getting to me, and I am picking over the bones of my figures everyday, trying to ensure my numbers add up and keep me below the £50 limit. I feel like I am going mad.

    Could be wrong, but technically you arent bankrupt........

    If the question asks "have you ever been involved in any insolvency proceedings" etc etc, then I would put yes.
