My Rights To A Refund?

We bought a fridge freezer to replace one which has broken. we have had it for 8 days located next to a stand up double fridge in a brick lean-to connected to the back of the house.
after 4 days the freezer wouldnt work, all food was ruined. when i contacted the company they sent someone out on the 8th day and said it was located in a cold environment and it should be in a warmer place to work, they will not exchange or give a refund.
what can we do? the old fridge/freezer worked in the room for 5 years the other freezer has also been in there for 5 years and is still going strong.
i contacted the store and the head office who said we have to complain in writing but they refuse to do anything. any suggestions will be greatly appreciated.
I think they are right.
I was once warned if ever i bought a second hand freezer that was switched off and sitting in someones garage,to insist on seeing it after it had been up and running.It was good advice.0 -

I Have since gone back to the shop and had a look at their display copy that has only been on display since just before Christmas and is in perfect working order with no defects so they have no quibble exchanged it and is still covered by the 3 year warranty0 -

I know that this has now been resolved but I would imagine that as a consumer if you went into a shop and bought and saw an lcd tv that you liked the look of which was on display and this display model had no dead/stuck pixels, you then bought the tv (new boxed tv) and the salesman/woman did not tell you that they had a dead tolerance policy and that this was not written down in the store or on the sales documents and your tv had then had dead/stuck pixels I would have thought you would have good grounds for refund or replacement under the sales of goods act and would stand a good chance in getting this via small claims court. The average reasonable consumer would not be expected to know that the lcd display may not be perfect and if they had seen a perfect working model on display it would be reasonable to expect that your set would be the same as the one you had bought. The standards and tolerances would only be binding on the consumer had he been made aware of them at the time of purchase.0
