Kevin - was the money actually taken out of that branch's ATM? Or another branch's?

I've never know this happen to anyone but have had a couple of friends who have had money missing from their current account before. One was actually in work at the time a withdrawl from a cash machine was made by someone else (obviously having cloned her card). She had to report it to the police and get a crime number as well as prove that she was at work at the time of the 'theft' which her manager had to back her up on before the bank agreed to refund the money.

Therefore having admitted that the card was left in the machine I doubt the bank will bend over backwards to help unless you get hold of a really nice customer services advisor.

The only way that someone could change the PIN is if the your wife entered the PIN and left the ATM in the menu. If this is the case then yes, they'd have a case for negligence.

When the user asks for cash, the cash is automatically presented after the card has been taken. This is a safety measure to make sure the customer is still there ("card-before-cash"). In this case, the card would have to be re-inserted (and PIN re-entered) to work again.

The key to this problem is: What transaction did your wife do at the ATM before leaving the card?

The answer to this may lay the finger at Halifax provided that the ATM wasn't in the menu.
  • Once your wife's transaction was complete the card would pop out.

This would mean that to use the card to take out £200 the person would need to know your wife's PIN.

Unless they were hanging over your wife's shoulder, they would not know this, so could not take out the money, even if she left the card.

Are you sure that the £200 was not taken out by your wife and she has just forgotten about it?

also the person that handed the card in , may not of been the person who took the money. i doubt whoever stole the money would then walk into a branch and hand it in. i would hate to think the person who handed it in , in good faith to get accused of taking the money if they were only trying to be a good person.

To be fair the OP states that his wife was paying in a cheque, not taking out money.
