car off ebay

bit hard to explain but ill have a go
the old fellas sold his car on ebay using my sisters account , its a 1972 rolls royce soft-top , a fella from hungrey won the auction , after a fair few emails he managed to pay via bank transfer and everyones happy or so it would seem , this was the end of october , the old fellas still got a rolls on his drive !!!!!!!
a fair few emails have been shot off to the winner , i dont know the exact nature of the emails but id guess they would ask the same as ive been told and thats can we have details of when the shipper will be coming to collect the car , what little communication has been returned was at first a sorry im on holiday for 3 weeks so will arrange something after this date and i will arrange something as soon as poss , oddly we do not have his name only a first name ( havnt asked for his details as yet ) , most emails seem to be ignored and we have no phone number , address nothing , we have had the money happly enough and the old fellas spent it happly enough but other than this were a little stuck with what the hell to do next
ok so where the hell can we go with this , we sold a car but contractually it wasnt sold as the fellas paid but not accepted the goods as hes not had a look or sent anyone round to retain the keys and logbook , the old fella cant send the logbook off to remove responsibility as he has both a duty of care to look after the bloody thing untill advised otherwise but being realistic this cant go on forever , he of course doesnt have a name for the logbook either , hes very tempted to drive it off to the local asda and dump the bloody thing as hes sick of looking at it but i figure this would leave him liable for the car , now as far as im aware if he were to contact and give this chap a reasonable time frame to collect ( 28 days ) it wouldnt be out of the relms that he would own the car again if this fella didnt collect , however whats reasonable and how long is debatable andddddddd there would be no proof he had recieved this deadline as no recorded letter/proof email was received , dam ,,,,,,,,,
friends think we should charge storage costs to the tune of 40 quid a day but these are wide boys thinking take the money and run
i think he should give a deadline then sell it again but at auction and retain the funds in a bank account for the fella to receive within say 6 months or the old fella keeps the £ , the amount it receives wouldn't matter ( downturn in classic market plus the rollers getting ignored and is being kept outside now so is deteriorating condition wise ) as long as he doesnt touch a penny and retains all receipts
the old man doesnt have the money to pay this man back as he sold the car to pay for an operation , it means he cant try to re-sell it on again as if there is a short fall he wont be in a position to make this up and to be honest neither should he
the tax /mot and insurance cant last forever , theres 3 months left
the only people we can think who are in a position to pay this sort of cash for a car then ignore it are the russian mafia ,,,, gulp ,,,,, so its got to be a legal outcome regardless , also the old mans just had enough of this and simply doesnt want the car or anything to do with it

i agree,i would give the buyer x amount of time to collect
then relist asap
leave the money in the bank or if you can afford it stick it in an ISA or the like and let it work for you (only if your old man can refund from his own money/what the roller makes 2nd time around)0 -

You can't do anything with the car, it belongs to the buyer.
It's only been 8 weeks...
Unless there's anything in writing up front you can't do anything.
I know this from bitter experiance as I sold a lorry to a bloke from the Congo, and he took 18 months to finally collect it, but he messed about, we had a 360 poised to squash his lorry if he didn't just get in it and drive it away, but even that didn't deter him...."Love you Dave Brooker! x"

Given he no longer has the money to refund the buyer, and no terms and conditions were agreed prior to the sale about storage costs, and a deadline to pick it up, then there's not a lot he can do.
You could re-list it on ebay with a reserve, so that if it resells, there'll be enough money to refund the previous buyer. He should specify that the buyer has 28 days in which to collect the car, and any subsequent days will be charged at £12 a day storage (what the police charge for seized vehicles!).Should've = Should HAVE (not 'of')

You'd have to refund first, otherwise you are selling someone elses property. Until the buyer has the money back in his account, the car is his and as there were no terms agreed he has all the time in the world to collect it. About the only thing you can do is to move it off of your property and out into the street, as long as it is legally parked.
Is there anyway that you can sign off the log book and officially make it the buyers car? Then it is no longer your legal responsibility if it gets towed or if the tax disc expires.We have removed your signature - please contact the forum team if you are not sure why - Forum Team0 -

You have legitimately attempt to contact buyer and keep all emails. Eventually the car is for you to re-sell and keep all the money as buyer have not responded and collect within reasonable time frame.

I think the moral of this is, only sell to uk-based buyers.
I have sold 4 vehicles on ebay & only had to take payment and do the paperwork.Never Knowingly Understood.

The buyer has a receipt that says otherwise, and until a refund is issued it belongs to the buyer. You can set a time frame, as long as a refund is issued prior to any attempt to sell the vehicle again, but there is no legal way that you can start charging storage fees as the seller did not state this in the terms of the sale and buyer did not agree to it, so there is no way to enforce the fees.We have removed your signature - please contact the forum team if you are not sure why - Forum Team0 -
